  • Hi, I would like to know if this affects credit card claims. There was already a ruling by the OFT that the maximum charges should be £12. surely we should still be able to claim the difference between the late payment fee charged before the ruling and the fair charge. Some of my cards charged £30 , so I should be able to claim the differnce of £18 for each charge. Could someone shed some light on this ?

    If you make a claim, the credit cards will offer you the difference between £12 and what you paid.

    I refused this, and CAP1 & HSBC paid all the charges back (CAP1 interest too + court costs). Lloyds TSB is now with the FOS, and Barclaycard with the courts.

    But if you just want the difference back, you should have no problems.

    I still think, however, that they may start using this test case as an excuse, even though its for current accounts only. You know what the banks are like.

    Is it my computer, or as the MCOL site been down all day.

    Maybe they are stopping new claims, whilst they decide the way forward.
  • Hi Stokey, problem was,that I am in another country for a while and was waiting for their letter to be forwarded on to me. When it didnt arrive as expected I telephoned NatWest only to hear the latest news! I know now that was dumb. Still would like some advice about my next step? Do I continue as if nothing has happened?

    No, the admin fee is part of the deal for the balance transfer and will be in the terms and conditions that you accepted as is the change of interest rate if you didn't pay in time.

    You can however claim back the late payment fees.
  • After all that has been happening concerning bank charges ,has left me confused. I asked Barclays for bank charges back £650 in total they offered me £270 as goodwill gesture. They addvised me to contact obbnuss man I think? Anyway was in middle of form when was told by friend that nobody can claim against the bank now because of the case on the news. Idont know what to do can someone advise me do i carry on with obbinus guy or except or give up? Would be most grateful if someone can help thanks

    i wrote to the bank twice using the steps and on the 27th it was 14 days and they hadn't responded to my court threat.

    What am i supposed to do now?

    Can I still take Lloyds to court by filing through MCOL ?

    The !!!!!!!s did not respond to my court threat and I was going to put in the court claim, but now with this !!!!!!! ruling what am i supposed to do??

    The Financial Ombudsman is no longer taking on new cases so your choice is to either accept the offer from the bank if this offer is still available to you or start a court action.

    If I was in your position, I would take the money. £270 now is a lot better than nothing now, or who-knows-what in the future.

    Think of it as £270 gained, not £380 lost
