    I know Nationwide & HSBC are £12 now.

    I've got an account with both.. claiming from Nationwide so opened the HSBC just in case - I'll probably stick with HSBC though... just waiting for the the rest of my claim to go through - got half refunded in June! :D

    Its gonna drive them mad and they will have to sort this out!
    They can say one thing and do another constantly,
    I felt so guilty when they treated me as special circumstances,
    I felt it was unfair so i have let anyone that is in a similar position know what i done to get my money fast.

    Just got notification that my claim against Barclays will be at Preston. There defence is three pages saying more or less that I've been a pillock (couple of sentences would have sufficed as I already know this). They quote terms and conditions detailing charges and previous charges i.e £30 previously £25 but they seem to have forgotten that these were previously £20 perhaps they should have mentioned this to cover their greedy backsides a bit more.

    Anyway lets see if they put a stay on it.

    I was just about to post my complaint to the FO when the news broke last week. What I don't understand is the issue of Scottish Law being seperate. Following this test case, would scottish claims be treated the same as english ones?

    Further to my decision to proceed with court action I am a bit confused as to how my claim should be processed. I'm claiming for £11,400.56 (including interest) as this is over the stated amount for small claims (up to £750) and summary cause claims(£750 - £1500) I have found out that this would fall into an ordinary cause claim which looks to be far more complicated!! When I spoke to a court clerk in my town for advice on this she said it would be advised to contact a solicitor with regards to this matter.Could anyone offer some advice on this? Or has anyone else been in a similar situation?Lorna

    I'll call them and report back what they say but going off on holiday tomorrow so will have to do when I return!

    Hi,
    Got a letter today another £39 charge and we cancelled all direct debits, rang up said they had all been cancelled, but one hadn't been done by the bank not us we know we cancelled because of all these charges. They refused to refund it so we said another one to add to the charges. It is so annoying they are quick enough to take your money but when it comes to handing it back :mad: we are going to the court to fill in a claim form on monday to try and get it in the system.

    The amount takes it out of the "small claims" court and yes if you decide to take this to court then you would need a solicitor and could be liable for costs whereas "small claims" you aren't.

    What you could do would be to take the first year of your charges and see what they amount to and put in a claim for them, then if your case is "stayed" which is likely then that first year of charges won't be time barred and will be accruing interest during the stay.

    Don't be tempted to put in multiple claims to keep it under the limits as some courts will deem this as an abuse of the system. I would also suggest seeking some proper legal advice regarding this.
