    I agree. People like Conor make me sick. After a divorce with two choldren to bring up and no home or furniture cos ex in forces, and with a measly amount of maintenance to survive on, I have struggled for years with finances and every little mistake in budgeting has been penalised by the banks and made the situation worse. The banks make plenty by using OUR money to make interest for them and I certainly will continue my fight for a refund of these UNFAIR charges.

    IMO I think the reason the OFT and FSA have actually done the right thing..the banks are going to keep on charging as they say their charges are fair it is us as Claimants that are sayin that their charges are unlawful not Illegal...if the OFT/FSA agreed that banks could no longer charge until the test case was over..can you imagine the amount of Joe Bloggs that would say...'oh well doesnt matter if we go over our overdraft this week we wont get charged'....I can personally see the logic in this and agree...the OFT/FSA are looking after your interests as consumers..if the banks won..how would Joe Bloggs feel when he/she gets a schedule of charges handed out by the bank on the amount of times they have exceeded their overdrafts plus interest from 27th july 2007 till end of test case.

    I have just been on the phone with barclays and had a bit of a revelation when you originally send your complaint in (the first letter) you get the standard 'investigating take upto 8 weeks blah blah' they are also quick to qoute that they are allowed this 8 weeks according to the FSA. Whilst i was on the phone i said to the woman that I had given the bank the 8 weeks THEY quoted me according to FSA regs and they had not replied in their timescale so therefore THEY are breaking FSA regulations..could I be right?? would be interesting to find out for future communication between us and 'them'

    If you,re using the FOS to claim from then yes it is their timescale..if you are issuing a claim through the court then it is your timescale and as the OFT have ruled a test case then I would proceed as normal then get your claim in with the court asap as you will come under the Statute and Barred Act.

    Hi There!I'm in total agreement with you. I was diagnosed with Breast Cancer in 2005 and being reasonable fit and healthy and 33 years of age, this was a complete shock to my system. Where Conor has smugly pointed out that he in running to be financially very comfortable by 45 yrs old. Good for him but he should think about the fact that sometimes life can give you a kick to the teeth when you least expect it. I found that when I took ill I had no income and while sick my bank balance wasn't looking to healthy anymore and was at one point to ill to be monitoring my account. The bank wasn't exactly helpful and I found myself being heavily charged. I'm still suffering from this time. Conor should think about the fact that not all people that have the fortune to be in his position. I took this to be a forum to help and support each other and not to make people feel stupid because they've got into trouble with their accounts. Conor think before you make these statements!!

    Unauthorised Overdraft Charges come from non payments of direct debits etc..
    i my self have bee claiming from A&L since jan & i beleave they our one of the worst banks for paying up:mad:
    i am at the court stage as they defended my claim 6wks ago so i am hoping because its in the system it will go ahead.
    after reading most of these thread YES go ahead with your claim so its on the banks files for when the test case is over:D

    Not necessarily as it depends on the court as to if they stay all cases, as is happening in some courts, or if they decide to allow hearing to go ahead.

    However, anyone with a court date should prepare for their hearing to go ahead until told otherwise.

    I've just had a letter from D&G Solicitors (First Direct) informing me that due to the agreement between the banks and OFT that they are applying for a stay on my case. My court date is due to be 14th August.

    Ironically, they have sent me this letter just a few days after I wrote to the court asking them to consider judgement in my favour due to the fact that FD have not supplied either myself or the court with any details of their defence whastoever, despite them being directed to do so within 28 days (the 28 days expired at the end of last week).

    I'm hoping that the Judge in Cardiff will look upon their actions as 'contempt of court' and also as being 'wasting court time'.

    It's a long shot, but worth a try in my book. I know that many courts are granting stays, but to the best of my knowledge, Cardiff County Court isn't one of them !!

    I am due to attend Cardiff Court on August 14th as well, i rang the court yesterday and was told they will be granting a stay and they are trying their best to send all letters out quickly, i havent yet received a letter but i am taking that as its definitely stayed. I will be sending of an application to have the stay removed after speaking with many other Cardiff attendes over on the CAG forum. They have been a great help. Go and take a look at a few hsbc threads over there and you will discover a load of other people who have been stayed by HSBC (and a lot who are due to go to Cardiff) and what they are planning to do. I dont think we can give up now as we were so close, there are definitely now no guarantees but i feel like ive gotta try until the fat lady sings, so to speak!
