Hi,
Theres alot of firms in the back of papers offering no win no fee,
But as we all know they rip you off royally, I know in my area alot of solicitors have a dropin clinic where you can get more info on cases and they let you know what the procedure is for them to take it on, they also let you know costs.
Its a way for them to drum up business, maybe look around and see if your area offers something similar.

In the above circumstances this may come under the umbrella of "financial hardship" and so you need to write to the Financial Ombudsman and ask them if they will take on your case.

Hi Edinburghlass!I spoke to someone from the Financial Ombusman last week about my case. As I aready had a complaint raised with them with regards to my Bank (this due to my bank not sending me a list of my charges within 40 day period). I was told that they could not help me and that all cases were frozen until the test case was over. They didn't seem to want to know!I'm so frustated as I know I should have received this money well before now. Because the bank has went over the deadline of 40 days that the Information Commissionaire has confirmed and the bank mixing up my account nos. (which caused further delay!) I'm still the one to lose out!!!I could pull my hair out!!! (that's serious business to me as my hair is now very precious to me - like gold dust - as I lost it all going through Chemo!!) Well at least I can still laugh at myself! Although the banks are slowly draining that out of me!!Lorna0 -
Right, can we step back to the beginning! You complained to the FO due to not receiving your list of charges, have you now got them? Have you put in a claim to the bank at all? If you have, have you gone through both letters giving them 14 days to reply to each letter?
If you have you can then start court action, except thats not a good idea due to location and the amount, right so far?
When you phoned the FO did you just ask them if they would take on your case? If so, then yes they would say no as they aren't taking on any claims now.
However if you are suffering financial hardship the bank should look at your case and if they refuse then the FO will take it on but I would say all this is so new to all people answering the phones at the banks and the FO then you need to persist and put it all down in writing.

Sorry Edinburghlass!I must be driving you nuts! You have the patience of a saint! Ha! Ha!The bank I'm with is the Bank of Scotland.I must admit I only asked the FO to look at my case but not under the umbrella of financial hardship. Also I had a look at the other thread of people discussing financial hardship. I was interested to read that the banks are not allowed to charge accounts that are only receiving benefits. While I was going through Cancer treatment I was only receiving benefits after my Statutory Sick Pay from work ran out and I was heavily penalised from the banks during this time. Is this another area I can use when discussing my case with the FO?I hope this is a bit clearer for you!Lorna0 -

Get out a notebook tonight and write down your claim from start to finish and all the details you need to ask someone at the FO before you phone them again.
I would also follow up any phone calls with a letter confirming what was/is discussed. As regards seeking a solicitor's advice, do you have any insurance that gives you free legal advice as it might be an idea to phone them or indeed CAB.0 -

Thank you very much for your time Edinburghlass!Unfortuntely my home insurance was changed over last month and I only found out that I have a 90 day waiting period before I can utilise their legal services! What luck I have!!! I change home insurance to save money and end up losing out due to this! (you got to laugh!)I will definately do my homework tonight before I speak to the FOS tomorrow and I will back it up with a letter of confirmation about the call.Thanks again Lorna0 -

I have just registered with this forum.
At the end of last year I was encouraged by a friend who was successfull with reclaiming her charges, to set about doing something about mine.
I wrote to Abbey and got as far as a "Gesture of Good Will" of 800pound returned to me, then when I tried to go further they said it would go to court. I tried to complete a spreadsheet to include the interest and couldn't manage to do it, I was also really scared of the thought of going to court so I didn't persue it any futher.
I also applied for my account details from Barclays, Evans and Capital One.
I got the details back from Barclays and Capital One but by then I had become really scared of the whole process and didn't follow it through.
My question is can I re-apply now? and if so is there an easy way of completing the spreadsheet etc?

Hi
HAs anyone had their cases put on hold by the judge as a result of the OFT decision. On Friday last I had a notification that the judge hearing my case had put on hold the hearing until after the OFT case.
If I am reading things right this is not what Martin has said should happen as the Chief Justice has not directed this. It says on the form I can ask for the jearing to go ahead but if I do is the beak going to take a dim view of me.
I've been trying to get my charges (several £ks) since December last year and I don't really want to wait until december 2009 whilst the appeal process is gone through.
My question is can anyone advise my best way forward0
