  • I have recently made a claim with Lloyds for £1,192, they have acknowledged receipt of my claim and now state that they are looking into it.
    As the 14 days are now well up (in fact it's around 4 weeks now) should I give them a phone call to gee them or take it to the next step and threaten court action?
  • go to the next step.. and state you want a reply in 14 days or you will be going to court.. then if no reply in that time either file on MCOL or with FO.
    Stick to your timetable as they will try time and time again to fob you off.

    Another success story!:beer: (will also post in the relevant success story forum!)

    Started back in March of this year, claiming back £3,238.50.
    Got the usual fob-offs from Lloyds bank's Andover centre so threatened court action on 2nd May. They failed to respond, so commenced MCOL after fourteen days.
    Anyway, Lloyds solicitors eventually responded saying they were intending to defend the case. However the following day, I got another letter from them saying they would settle in full with me!

    Sent the acknowledgement slip back by recorded post, which they got on monday, and the money has appeared in my account today!

    CLAIMED: £3,238.50
    RECIEVED: £4, 240.12 (including court charges paid and interest recalculated!)

    Phone the court and tell them the situation, you can issue a warrant for approx £50.

    ive had the same amount and until i just read the letter back i didnt realise they had put it in my bank!! its not even half of my claim either(1980) think im going ahead with mcol but im unsure at the moment i suppose they just give you the difference if you win.

    I really don't understand why so many people on here mess about calling the bank and waiting for the banks to respond when they want! Reverse the situation:
    You owe the bank 1,192 and they want their money back, do you think they would allow you to set the time frame in which you have to respond to them, NO!
    Would they accept a letter from you stating that you are sorry for their complaint against you and that it will take you a further 8 weeks to look into the situation, NO!
    If you didn't respond to them in the time frame they set out with the threat they if you didn't respond in the time they say they will take you to court, do you think they would call you up to see whats going on, NO! they would have you in court quicker than lightening!
    Don't waste a second longer deciding if you should give them the benefit of the doubt, go to the next step and stick to the time frame that you set out, otherwise they think that your threats of legal action are just empty.
    My case took 2 and a half months from start to finish (they settled out of court for the whole amount of 2350) and i put it down to me sticking to my time frame and not taking their rubbish excuses.

  • ok.. kinda the same but kelly puts it way better!!!
    the banks do treat us like crap.. so got to put them on back foot and go at it full steam ahead.

    correct....if you dont want to go through mcol you can use the FOS they are free and deal with your complaint, plus the bank gets fined if they dont comply and I think these days the FOS is actually moving quicker than the court system.
