Had the same reply. I am bout 3 weeks down the line and heard nothing! From the posts on here, Lloyds are not very forthcoming with hardship claims, so don't hold your breath. I think it is going to end up as a FOS claim, however they do not look very favourable at the moment either from some of the comments posted.

You will need to contact the Andover branch, which is recovery which is mentioned on the other thread about hardship claims. However, they do not answer their phone and it rings then cuts you off. When I called I was told it was not a direct number for Andover as they do not take calls it is by writing only. You have to write to this address stating your claim. They then send you a bog standard letter telling you to wait as they are dealing with it. I m still waiting 3 weeks later, but not holding out much hope. Everyone seems to suggest they are ignoring the hardship rules completely!
  • I've written dozens of letters to Lloyds and have provided them with tonnes of evidence to prove financial hardship and they have never dealt with it. On the phone they told me there's no such thing as a hardship clause in the waiver. I've got my form filled in for the ombudsman as I don't believe Lloyds are complying with the hardship rules at all.

If you think I've been helpful then slap me with a thanks. If you think I've been unhelpful I don't need your negativity right now.

  • thanks for all advice!
i've written the usual reclaiming letters, it was just i thought there was a way to get my case looked at quicker - guess lloyds are yet again, particularly unhelpful!
  • Thnx for the reply i really hope i can get this sorted quickly, after loosing my job i am doing agency work and im only getting 2-3 days a week, i would have been alright on this but the bank charged me £130 in one go which has put me in the red, now the little money i am getting is getting sucked up on charges :(

Is this letter they sent designed just to give them a few weeks more time then?

Would i still be able to take them to court after the 4 weeks through small claims then? I am trying to work everything out but there is a lot of information and its hard to work out what applies and what does not.

Good luck and id appreciate it if you post in this thread again after the 4 weeks and let me know how you got on.

Also any threads that are relevant to my situation id be grateful for a link.

    Many thnx.
  • Hi CougarRules and k1mmie

We eventually had response from Lloyds complaints dept but it did take about 8 weeks for them to finally get back to us.
I'm afraid that they didn't seem to be fair in our case, stating that they didn't believe that a Lloyds manager would have verbally made us such an offer and that we were probably mistaken.
Probably not the kind of answer you were hoping to hear but that was our experience of the Lloyds complaint department.
We are now awaiting a decision from banking ombudsman, If they can't help we will then be taking legal action.
Good luck and please post again when you have a reply.

  • Mungos mum when you wrote to the bank are you in and did you say in the letter that you are experiencing financial hardship? Are you saying also that an actual branch manager made you an offer?
  • Hi CougarRules

We didn't say that we were experiencing financial hardship but that we would soon, due to Lloyds actions, have financial difficulties.
Yes it was a local manager that made us an offer.

    Hope this helps

Good luck and keep fighting, one of the good things about this forum is that it proves that the likes of you and me are not alone.
  • Hi, can anyone help? Have just received a statement from Lloyds who are charging me £190 for 8 days going over my agreed overdraft limit. Basically, can they do this or does it fall into the category of unlawful charges that everyone is claiming back at the moment? Thanks
  • It would come under the unlawful charges. Thats £23.75 per day!!!
I used to suffer from lack of motivation.... now I just can't be arsed.
