    To be honest, at this stage its all guesswork and estimates. She can still put the claim in just in case. Just dont get her hopes up.

    £30 is too high in my opinion and but thats just my opinion. It counts for nothing. The OFT felt £12 was a more reasonable penalty fee in their early review on credit card penalty charges.

  • i have a loan through lloyds which i defaluted on due to a severe drop in my wage. no in the small print it says they can remove payments from my savings (got none) or my current account which they have done on numerous times leaving me short for my morgage,bills etc then to top it off they have charged me eccesive amounts to cover me going over drawn. all i want to know is this right as they have taken money out when i clearly dont have it in my account then charging me hundreds which is getting me in a bigger hole...... help please

  • They tried the same with me, £156 for being around £30 overdrawn for 10 days.

    I tried phone bank who told me I had to discuss a repayment plan with the customer services...so I went into the branch where even the cashier was stunned at the amount!

    She went in the back, came back after 5 mins and told me she'd wiped them!

    (I reckon this will only work though if they haven't already taken them!)

    In the Terms of your accounts, there is probably a provision for the bank to take money from one account to pay outstanding amounts on other accounts you may hold with them.

    If they are taking money from your current account which is directly causing you to go overdrawn, and then charging, then this seems a bit of a sharp practice. You can have a look at Martin's Reclaim guide for your options, the link is in my signature.

    If you are in financial difficulty, I suggest you also look at the Debt Free Wannabe board, where there's lots of help and support available.

    I called Lloyds today as I received the same identical letter to 3 weeks ago. I spoke to someone in customer support who informed me that no refunds are being given even for financial hardship. They will agree a payment arrangement and can help with any charges due to g on the account, however there are no refunds and I asked why not under the Financial hardship waiver. They said all they were obliged to do was help if you had an overdraft and needed to reduce your monthly payments and referred me to a CCCS for debt advice. Is this correct or are they supposed to be giving refunds if genuinely considered hardship. He went through income and outgoings and agreed we were eligible. Advice please!
  • hi guys, just to let u know, i sent a letter to tsb saying i was in finicail difficulty on the 2nd of feb, i sent my letter to brighton as i told this by tsb, got a letter back saying it had gone to andover , now today got another letter saying it had gone back to the right deptment guess where lol back in brighton , so its took them a whole month to get to the right place even tho i sent it there , now after been on the phone 2 tsb for an hour this afternoon cos no one had a number for brighton , i talked to a lady from andover who informed me cos i have logged mcol on the 1st of august 2007 i need to phone tsb solictors to see if they can help so, on the phone again lol to the solictors who informed me i to write a letter to them explaining my curcumstances . so if u are struggling and not filed mcol u need to phone andover if u have logged mcol then u need to get in touch wiv tsb solictors , thats just incase no one knows cheers jill

    I rang LTSB to request a list of charges, rang them back two weeks later and was told that my request had been passed on to the correct department.

    40 days were up and I still hadn't got the charges through, so I rang them yesterday,to be told that I had to send it in writing. Grrrr...:mad:
