It's not quite the same, since it isn't revenge !!!!!!, but it's no more Jennifer Lawrence's fault that somebody purposely hacked into her cloud storage and posted her boobs all over Twitter and Imgur than it is the fault of an account holder who has their bank information stolen and used without permission.
BUT - we should accept that there is a risk that the images will be misused and therefore accept the risk is ours for the taking.

If a person didn't allow an image to be taken then there would be no image to be hacked, stolen, misused etc.

It's about taking personal responsibility for your own online profile - if it's not there then they can't use it.

It's a bit like walking home alone in the dark and taking a short cut through an area known for mugging... you don't deserve to be mugged BUT you took the risk to walk though a high crime area... so have placed yourself in that position. The mugger is a bad person but you would have been foolish in taking the route in the first place.

Take care of yourself - don't rely on others to be responsible for you.

I wonder what the law is in such as case?

I believe there is a Misuse of communications Act which covers 'indecent' images being both send and received. Although, what is considered indecent is another matter.

More interestingly if you send the images who then owns the image once it leaves your hands? For example, I am sure that Google's gmail policy states that they have the right to use email content as they wish. So would they own the image?

Anyone know the law on who owns an image once it has been sent out to someone else? Would copyright law cover this?

Google's terms are in place simply because they have to be able to transmit the image. Momentarily, even if only for a matter of miliseconds, any email you send is on the systems of the email service provider. They cannot redistribute that message without having gained your consent to do so, which is why they have that in their terms.

There's a few laws such as Malicious Communications Act and such that sort of cover this, although to date it has been a bit of a legal grey area. They are however (pending parliamentary approval) implementing a specific law with a possible 2 year prison sentence for offenders.

My daughter was recently a victim of grooming and it broke my heart to discover this disgusting individual had convinced her to send him a picture of herself.

After a visit to the police station we discovered there was nothing they could do about it and we are all still trying to deal with the devastation this has caused.

Adults are mostly responsible for what they send to others whereas a child can feel intimidated and scared not to.

OMG I am so sorry is she ok now. It is my biggest nightmare. I am not a violent person but I would kill them all, the impact and damage it can have on young people is terrible.

Really really hope your daughter is getting over it.

    Something J-Law said about it
"I started to write an apology, but I don't have anything to say I'm sorry for," she says of her failed attempt to make a statement just after the story broke. "I was in a loving, healthy, great relationship for four years. It was long distance, and either your boyfriend is going to look at !!!!!! or he's going to look at you."

I have t agree with her on that point...

But if we should just accept that risk and blame the victim when it happens, we might as well blame the victim in every scenario. If you get mugged, it is your fault because you had something the mugger wanted. If you're burgled, you shouldn't have any stuff to nick. If you have your online account hacked into then you shouldn't have stored your money in a bank. If, if, if...

Yes, there is a risk but it isn't your fault if some worthless parasite decides to try and damage your life out of some petty revenge. Yes, you misjudged the person - because everyone misjudges people at some point in their life. Victim blaming should stop.

Was going to type something but this explains it better than I could. The people hacking are still the big baddies but why even put yourself at risk.

    Totally out of contex.

If someone breaks into your house and you have left your door wide open, the keys in your car and cash on the kitchen table so sorry but your fault.

If you have taken every precaution locked your doors etc then you are less likely to be broken into. It may still happen but it is less of a chance.

So it is acceptable to blame the victim of a sex crime if they haven't taken some arbitrary "precautions"?

Because that is what revenge !!!!!! is, it is a sex crime.

And out of interest, when somebody waltzes in to your unlocked house and nicks your stuff, since it is your fault, should we not prosecute the thief?

You can instead take control of your online profile. No disrespect but I am a member of a forum it does not mean that I am going to tell you where I live want my full name and date of birth is.

Accounts get hacked, face book gets hacked but you can limit the effects. Will try and find it but there is an amazing video about what would real life be like if we all conducted ourselves like we do on facebook.

But the discussion isn't about what people have on their online profile.

It is about people using what should be private images to victimise somebody out of revenge.
