If I leave my car unlocked with the keys in the ignition, someone getting in and driving off is still taking without consent (if that's the current version of the offence). The fact that it was easy for them to do does not stop it being a crime and simply wrong.
What insurers will pay out on is not relevant to whether or not an act is right or wrong. Insurers can victim blame for not mitigating their loss / taking reasonable steps to prevent the theft as their contract of insurance may require, the criminal law however should not.
Ok so playing devils advocate for a moment, we both agree that victim blaming is not right , serves no purpose etc. When does the line cross and it stop become victim blaming to taking responsibility.
For example. 1996 we had a car accident, horrific! A small child ran out in front of my OH who was driving. It was just by a park and the child slipped out of parents hand and ran across the road. My OH was amazing and thankfully because of the way he acted straight afterwards the child was ok.
In the eyes of the law the child was the victim. Police all witness's even parents said it was not my OH's fault. But in this case it was the victims fault. My OH could not drive for a long time. Had a real problem with the whole nightmare. We had to pay a fortune in insurance for years because of it.
In this scenario the victim was at fault or should I say the victims responsible adult. Not my OH yet we where penalised, my OH mentally and financially.
If I chose to stand in front of a bus is it my fault if I get knocked over or the bus drivers?
Again I stress victims come in all shapes and sizes and this is a question that I personally think is very difficult to answer as there are a lot of grey area's. It is not as simple as to say that it is never the victims fault because there will always be scenarios where it was. Equally it is not always possible to say that it is never because in nearly all cases it will not be.
Not trying to start a keyboard war but just wanted to see what everyone thought as a lot of this thread seems to hinge on blame and fault.
It is always dangerous to generalise and this is more a theoretical question. Again please do not miss understand me. I am not saying that any form of criminal, fraudulent, or invasion of privacy activity is ever acceptable.Happiness, Health and Wealth in that order please!:A0
