I disgree - Arval (and other lease companies) have had plenty enough time and chances to get this right and simply decline to do so. Time to fire the guns.
This post refers to my previous one which I have deleted. On reflection, I think I was wrong and that a reply like Bazster suggested was correct. My initial objection to Bazter's post was based on a few of his sentences and I would have kept it less emotive and more business like, but actually he has dealt with the letter point by point and it covers everything it needs to, so don't mind admitting I was wrong.0 -
agreed, they upped the ante with the legal c**p so do the same and rubbish their letter , but treat it as if its an LBC and always counter any such letters in case they tried an MCOL or suchlike, so by countering now using the baz letter (with the additional BVRLA comments) it puts the ball back in their court
I also think that after almost 2 years of POFA 2012 they should know the score by now
its all the old incorrect information (including the word FINE or PENALTY) that is the bane of this job0 -

Just received this back from Arval, it seems they are willing to fight this a little longer by the looks!

We have investigated in full your issue regarding the charge you have received against *****.
On receipt of any parking fines Arval will check that the company is registered with the British Parking Association. As long as this is the case then on receipt Arval's policy is to pay all fines/charges in order to reduce risk. Delays or failure to pay and deal with these could lead to increased costs to the customer.
A private parking charge is covered within section titled ‘Liability and Indemnity’ of your contract. This refers to payment of fines or penalties for parking, driving or similar offences incurred by Arval relating in any respect to Vehicles hired.
If you are not willing to allow us to transfer liability then any further charges incurred will be billed accordingly as per our standard process.
If you are not happy with this response , you do reserve the right to refer your complaint to the Financial Ombudsman Service. The Financial Ombudsman Service is an independent and free service. You can find useful information on their website.

How many more time do I have to point out that this is not a fine, it's not a penalty, and there has been no offence? It is merely a speculative invoice from a private company, as I am getting thoroughly sick of explaining to you.
I couldn't care less what your policy is, my concern is solely with the legalities of the situation. A private parking charge is NOT covered in the contract because a private parking charge is NOT a fine or penalty and there is NO offence. Why is that so difficult for you to understand?
I reiterate: if you make any charge to my card relating to this or any other private parking charge this will be outwith the terms of the contract and will be reported to the card company as an unauthorised transaction. You have been warned.
