    No sarcasm intended - just thought you were being unduly optimistic in expecting any sort of substantive reply to a list of tricky questions within 7 or 8 working hours.

    Re-read my post. I didn't say I was expecting an answer now. I was just asking how long I should leave it before following up. 3 days? 1 week? That's all. The Council may well have replied within a day or two to say they would instruct PCM to cancel the ticket,. Or they may well be answering all the questions put to them. You (or someone) could quite easily have said "give it a week" and I would've been quite happy with that.

    Well if I recall rightly you are awaiting the NTK anyway so don't even need to think about it until August, and you'll either get a reply to that email or the NTK first. A Council reply will take as long as it takes them, same as any complaint letter to any Council Dept about any subject. I would say get on with your life until one or other arrives in August. :)

    So I've had an email back from the local Council...

    "I am currently looking into the issues you have raised. In order for me to check whether you were parked in an area which should be patrolled by PCM (UK) Ltd can you please supply the PCN number and/or your car registration number. This will enable me to check the details direct with PCM (UK) Ltd.

    Once I have this information I will do further checks with PCM (UK) Ltd and respond to all your queries in full."


    Should I give them the info they have requested. Or just explain that I was parked at the very beginning/entrance to the Road in question? Or I could send her the pic of my car (number plate covered) parked there?

    So this is what I sent back to the Council yesterday...

    Thank you for your email and I appreciate you taking the time to look into this matter.

    The PCN Number is ********. I request that you DO NOT share my name or any personal details with PCM when enquiring.

    The vehicle was parked at the very entrance to ***** **** (at the Junction of *** ****). Their are no signs or road markings at this point in the road. There is also nothing to delineate where Council Highway changes to (presumably) private land.

    Ok, so I've finally heard back from the Council...

    Dear Mr ******,

    Further to your enquiry I can confirm that I have visited the site and can confirm that your car was parked in an area that PCM patrol. This scheme has been in place since 2011 and PCM have been responsible for patrolling the area since then. The scheme has recently been reviewed and residents are going to be issued with new permits, however, the scheme is continuous and therefore PCM should be patrolling the area.

    The Housing Department has introduced controlled parking in areas where residents are unable to park due to non-residents parking on the estate. Our car parks are for resident and visitor parking only and PCM enforce this. PCM operate the service free of charge. We do not pay for their service and they do not pay the Council. PCM keep all monies received from the Penalty Charge Notices they issue.

    ***** Council has a contract with PCM however I am not obliged to provide you with a copy of our contract with PCM. If you wish to request a copy I would advise you to submit a freedom of information request via email to foirequests@********* who will consider your request. I understand that A2 Dominion also have a contract with PCM as they have properties on the estate but you would need to contact them direct for any further information regarding this.

    We are aware that PCM are no longer part of BPA but that is not a requirement of our contract with them.

    When a driver parks in an area it is the drivers responsibility to check for signage to ensure they are permitted to park in the area. The signage on the road where your car was parked was clear and your car was parked only a few metres from a PCM sign. The Council does not get involved with disputes over PCNs issued and you will need to follow the appeals process with PCM if you wish to appeal against the penalty charge notice.

    in that case they have agreed with my post #19 , its a private road - private land , patrolled by a private parking company

    so its the IPC route and IAS for appeals (not the BPA or popla)

    suggest you re-read this thread now and bear in mind everything said about this being a private road, PPC is in the IPC and all appeals procedures etc (to get your head back around it seeing as its not a public road and free parking)
