I just noticed a few glaring errors in the above post so I have amended it. It should make sense now.
Should I also include a request that the Council contact PCM to get this PCN cancelled in my email back? Or wait for there response first depending on who the Landowner is?0 -
I would put a comment in that clearly states that the car was parked on the road which you thought was a public "council" road and has nothing to do with driveways or residents parking or parking permits , so their answer assuming it related to driveways for residents etc has no bearing on who owns or maintains the actual roadway0

I would not admit anything at this point, as to who was driving, you are enquiring as RK as you are entitled to do having received the paperwork
I also think you need answers before apportioning blame, so lets see what they say before asking for pre-emptive strikes based on assumptions

Thank you for your email. Whilst I appreciate you seem to have some parking "issues" affecting the Residents in ******* Road, the issue I want to bring to your attention relates to ****** Court, the very entrance to it to be more precise.
Last week, the driver of my car received a Parking Charge Notice from PCM to the extortionate amount of £100. The vehicle was parked at the very entrance to xxxxxx Court (by xxxxx Road), where the driver has parked in the exact same unrestricted spot on half a dozen previous occasions (the driver works in ******* Primary School).
The restrictions are only signed beyond that area (signs start halfway up the Road on the entrance to a Housing Estate Car Park) and not before. Also there are no road markings on this Road at all to state specifically where the restrictions are or start. There is also nothing to delineate where Council Highway changes to (presumably) private land - either that or PCM are issuing tickets where they should not.
It is only once you are beyond the signage and inside the Housing Estate Car Park where you can see clearly visible road markings and parking bays for local residents.
To the driver's knowledge, the car was parked on a public "Council" road that had nothing to do with driveways, residents parking or parking permits.
With the above in mind, I must ask that you clarify the following...
- have PCM overstepped the mark by issuing a PCN outwith their boundary? Where does the public highway end? Have you a map please?
- you say that residents are going to receive new permits after which 'any vehicle parked without a new permit will then be subject to enforcement action by PCM. Have PCM overstepped the mark by enforcing the new permit scheme before permits have been issued to all residents?
- on what basis were PCM chosen to enforce these charges - was there a tendering process and how much are they paid?
- or do they pay to you/anyone else for what is in effect a 'fishing licence' to catch motorists here for their own profit?
- What is the reason for the parking charges, has PCM been installed to deter breaches of rules or to issue fines?
- What happens to the money from the parking charges? Who keeps it and if it is split please explain in detail what it is used towards?
- Who has the contract with PCM, is it the Council or xxxxxxx (or someone else)? I would like to see a copy of this Contract by return so I can see the scope of rights assigned to PCM and the intention behind the scheme.
- Were the Council told when granting the rights to 'enforce' here, to these notorious ex-clampers, that PCM were members of the BPA (as if that is some sort of regulator, which it is not)? In fact, PCM are no longer members of that Trade Body, did they tell you about this change and is it fundamental to the contract that you have a BPA member firm here?
If you, xxxxxxx, or the Landowner refuse to provide any of the above information I will do a FOI request separately for it as it's needed by me to make an informed decision about my appeal to this outrageously over inflated "fine".
Just one final note. On the home page of xxxxxxxxxx.co.uk, there is the following statement:
"Our aim is to work closely with xxxxxx Council and residents to create a neighbourhood where people are proud to live and work"
This is all very well, but if you have insufficient parking spaces for people that do work in the area and invite in a firm of notorious ex-clampers (with a terrible online reputation, easily Googled) to issue such exorbitant "fines" so freely, then I'm afraid your "aim" will never be achieved! This is not a shining example of your stated intention to put in place a strategy to improve parking conditions.

You've asked more than a dozen 'difficult' questions; how soon do you think they should reply?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

No need to be sarcastic. Thankfully I've not had to do this before, so was just after some sort of guideline from others who have.
Anyway, got a reply from the council this morning...
