PCM - Are they an Approved Operator???

Bazza,
The advice you have been given is quite clear.
PCM have issued a windscreen ticket = a Notice to Driver = NtD
Do not send in appeal yet.
Wait until they send a postal Notice to Keeper to the Registered Keeper.
There are good reasons for this as provides stronger appeal points
The Registered Keeper then sends the 1st appeal template letter to PCM
Now please read the NEWBIES thread so that you have a clearer understanding of why you have been given the advice you have.
EDIT: Apols - our posts crossed - yes along those lines0 -

Ok thank you. It's just a lot to try and take in and I'm at work too so it's just frazzling my brain a bit trying to understand it all and get everything right! lol.
Will sit tight and wait for the NTK and come back.
Thanks all once again for you helpful feedback - I apologise if I'm coming over a tad cautious/stressed. Threats of extortionate "fines" (invoices!) and Court Action do worry me when it's something I'm not use to and I've got my twins birthdays coming up in a couple weeks time which is only adding to my anxiety!! I don't need this extra worry!!0 -
Hi Bazza,
Try not to get stressed out about it - they really aren't worth it.
No point frazzling your brain, the NtK won't arrive for at least 4 weeks so use some of the time in between to gen up.
When you do - sit down with a cuppa to read the stuff through.
Do it a bit at a time and it will become clearer

you also need to inform the driver to stop trespassing on private property (in this case that road, or any other private land or private car park)
the fact there are no parking spaces nearby does now allow anyone to just park where they like. I appreciate the driver didnt know this before but they do now and those signs do say its private land for permit holders only , so no point repeating the mistake. the driver has no right to park anywhere at all but if they must do so it should be on an unrestricted public road or car park and not private land patrolled by these parasites
as stated above, keep reading it over a cup of tea until the subject matter sinks in, you cannot absorb it all in one go and you must realise we have been learning this subject over a much longer time period
we do understand, but all the correct info is in this thread, it just needs absorbing until the eureka moment arrives

Out of interest, how is anyone supposed to know that one road within a council estate is OK to park in, but an adjacent road is not, when the signs are a good 15-20 yards down the road?
Do they not have to have signs (along the lines of) "parking restrictions exist beyond this point". Otherwise how is anyone going to know where the dodgy area starts??0 -

Which is why PPCs thrive; all part of the PPC business model! Welcome to the world of Private Parking! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

is also a good question for the local council and their trading standards department - this was why I kept mentioning unadopted roads and that your driver has to learn to differentiate between public roads (the ones we are all used to) and private roads, private estates and private car parks where different rules and laws apply
its good to see that with more time to reflect on this , you are finally "getting it" as the penny drops , which has happened to most of us too at some point0 -
Who is the registered keeper, a family member or a company/lease hire firm?
Also in the Newbies thread it clearly tells you NOT to use mitigating circumstances.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Is it ok to say who the RK is on here?
I think I've managed to find out who the Landowner/Landlord is. The area is being regenerated by this Housing Group, so hopefully they own this poxy road too!
I've sent an email to them asking the question as "I have a query with the Parking Control Company that are being used to "control" the parking on the Estate and I would like to bring it to their attention as a matter of urgency."
Once I get confirmation of who the Landlord/Landowner is, I will send something more "forthright" and use some of the points from the template Appeal Letter etc...
Ok so far?0 -
Coupon-mad didn't mean that you should actually name the RK, only that you should clarify whether the RK is a family member or whether the car is registered to car hire/leasing company.
The advice is different if it's a hire/lease car.
Good progress on tracking down the landowner btw - that all sounds fine0
