But Mr. Beavis will require a barrister will he not, unless he's going to defend himself? Don't think a lay representative can act for him in the Court of Appeal?
Worry ye not. I am sure there will be a taker and we will find out in the fullness of time!

There were. And he's now got a top QC taking the case, so those of us who were helping will step aside, and let him get on with it.

Thanks to all who offered to contribute, but a fighting fund won't be needed.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

One view might be that the judge was playing a canny game and knew exactly what he was doing when he ruled in PE's favour.........ie by ruling in their favour he opened to door for an appeal by the driver....which could generate a binding decision.

I doubt if PE would have taken up an appeal if they had lost [too much to lose].

Or else the judge really did think that £100 was a fair illegal penalty that was legal to enforce.

I wonder if we will ever know what his thoughts were??

Yep I can't fathom it - but equally I don't think his agenda was in favour of the consumer - so it's best that it will be heard afresh. Who knows, though, what the COA Judges will decide?

All we can be sure of ... is that PE (with BPA support no doubt) will be taking this seriously and will throw whatever they can at this in an attempt to win the appeal.

Well, at least we can say "we live in interesting times" Is it Capita that own PE now? So support may well be forthcoming from that direction.
