Just bear in mind that PE have played canny with this, in that they pay to "lease" the car park in question. This only accounts for a very small proportion of car parks that PE "manage". So the outcome of this appeal may not be the "grand toppling of PPCs" that we may hope for.

Potentially not, but we may get lucky, the main question that needs to be addressed is whether GPEOL in a business to consumer contract can include business costs.

A judge who can see through the BS will not fall for that "lease" baloney. If ParkingEye leased the car park they would be responsible for all manner of stuff, but all they actually do is send out fake tickets, they do nothing else that a genuine lessor would have to do.

Whether such a judge is available is another matter entirely.

Court of Appeal hearings are normally held in front of a panel of three Judges, with the title Lord Justice (Name). So at least two out of the three need to be on our side.

I am reminded of a case some years ago, when Paul Gascoigne was up before the beak for something or other.

Barrister: My Lord, my client earns his living as a professional footballer.

Judge: Would that be Association Football or Rugby Union Football?

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

And if the judge has to walk, because when James parked the Roller, some twonk had parked in the very clear "no parking" spot that morning.......

And I suspect HMRC will be keeping a close eye on this too.
