They fail to mention that the judgement in essence only really applies to this particular carpark, possibly other car parks where their contract and business model is exactly the same..... strange that.

Who's giving inaccurate and misleading advice now eh?

If this judgement is appealed and won, will parking eye have to amend the information.
further more if it contains any inaccuracies would it fall foul of the advertising standards agency?
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"

'ParkingEye’s advice to motorists remains the same. If you have a genuine appeal of the charge, appeal to ParkingEye as directed on the Parking Charge Notices sent. If not, a 40% reduction of the charge is offered for early payment.'

Does anyone know if PE has ever upheld any appeal, on any grounds whatsoever?

Yes. If you can prove that you were a genuine shopper and spending a reasonable amount, then PE have a fair track record (compared to other PPCs) of cancelling tickets.

It is amusing that they can't even spell 'judgment' in the legal sense!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They did once uphold my appeal after a double dip incident. I did tell them I had tracker evidence and would charge them my costs though .. :rotfl:
The word "gullible" isn't in the dictionary

From ParkingEye's boast: "Due to the large amounts of outdated, misleading and inaccurate advice propagated on certain online forums and blogs, ParkingEye has been forced in recent months to take legal action against those who fail to appeal or pay Parking Charges."
So its all our fault that they have been forced to send out thousands of court cases. I'm not sure whether to be pleased we have had so much of an effect on them or upset that they are using us as an excuse.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

It's up to the defendant. We'll wait and see.
