All we can be sure of ... is that PE (with BPA support no doubt) will be taking this seriously and will throw whatever they can at this in an attempt to win the appeal.
Of this there can be no doubt, for if they lose then the entire stinking racket is dead in the water. Which is why it is great news that Mr. Beavis has a top QC fighting his corner against Butthead. How this has come about I'm sure we will not know until well after the dust has settled, but I for one am content to let it be so and wait for Bargepole to update us when all is settled, for good or ill.Je suis Charlie.0 -
There definitely seems to be a lift in forum spirits tonight.
Interesting times ahead, with more to gain than lose for the motorist.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Will the three learned Judges be able to look at the whole penalty issue or just look at this commercially justified penalty?
Mind you if you cant have a commercially justified one then you cant have a purely for profit one I suppose!0 -
I wonder if this will be the beginning of something new... A time wreby motorists don't see private land as a free for all, a time where rules authorised by the company or agents are abided by, a time where a select few don't think they have the right to do as they please.
Let's face it, most car parks have plenty of signs covering maximum stay, covering the fact its for customers only, have clear areas to park so its not difficult to keep within the rules for the majority.
I don't like these companies tactics nor do I think the charge is proportionate to the 'crime'. But they certainly aren't wholly to blame for a significant portion of the tickets issued.

It'll certainly be interesting, as the concept of private "fines" as opposed to genuine losses is widespread, from the simple library fine, travel lodges smoking fine, and other similar schemes. Hope we get judges that can look at the whole penalty issue, and not just in parking.0
