    Sorry but I have been getting it for 4 years. When I got CA I was not told about IS but after 4 months I found out applied and got it. They would not back date it but I went to tribunal and because they had worded a letter wrong they awarded me the back dated. So I am afraid you are wrong and I am happy to show you my post office account to prove it. Everyone has taken over my thread and quite frankly are wrong on some counts and certainly this one.

    If you can get extra hours with a DP you should have then the flexibility to use an agency or employ direct However SS if you employ direct wont do it on a casual basis. You could see if the lady you want to use with your Mum the agency would take her on, this isn't an uncommon solution, this can save the hassle of being an employer. It wont hurt to do it casually to try this weekend especially if its someone you know.

    I really hope you can enjoy your break this weekend.

    Nanny is correct about the CRB for adults not SH I could dig the guidelines up for DP but on my mobile. If employing direct there is no compulsory CRB obviously advisable though if a stranger.

    Enjoy your weekend and I hope it goes well with Social Worker next week. Make sure they do a reassessment of need and emphasis your concerns.

    you really do need to but out because you have no idea what you are talking about!
    carers allowance is oaid, with a top up of income support to make it the same as a full income support award.
    THEN a carters premium is affed.
    the benefit entitlement therefore is CA, IS AND carers premium

    Rosie it might be worth you downloading the Direct Payments Guidance 2009

    There is also guidance in it on how Councils should support any disputes within families in case you have further problems with your brother.

    The section referring to CRB for adults with and without capacity is page 54 points 152 & 153

    Rose, I used to be an expert on utilising Boots vouchers, so that they were paying us to shop there! Can I recommend nannytone and Cattermole as being fonts of all knowledge on your query.


    Nanny has employed a PA for a long time, and Cattermole's employment experience has proved invaluable to me, in the complicated maze that is Direct Payments, and finding and funding care for a loved one.


    Incidentally, if you are in receipt of State Registered Pension, but don't receive Pension Credits, you can't claim Carer's Allowance. Good luck Rose, it's a damned hard road being a carer.

    I was a DP support worker for 2 years but also a user on behalf of my daughter for 8 years as a child and adult.

    Nanny is awesome in her knowledge of the system in benefits and as a DP user. :)

    Just wanted to clarify about capacity Rosie not sure whether you Mum has just physical problems or not? Anyway as its a useful point having dementia or a severe learning disability does not necessarily deem anyone automatically as having no capacity. Any decent Social Worker will recognise being able to indicate a choice even if that is just by showing they are happy with a particular carer through their actions indicates some capacity.
