    Hi

You do understand your legal obligations with respect to the employment of non-UK nationals?

The fine for failing to comply is now about £20K.

To avoid allegations of discrimination, you need to ask both women (and preferably any other person you interview) to provide the required dcoumentation and you have to be able to produce copies of that documentation if you are asked for it.

You also need employer liability insurance, and to arrange for both National Insurance and Tax deductions and payments to the relevant authorities.

As I said earlier I do payroll as part of my new job so know all about tax and ni. I am aware of the liability ins and would not employ anyone without a ni no. Also not discriminating as one of the ladies shortlisted is from eastern europe and has showed us her ni card. This thread was just about a bit of advice but has turned into a fight over carer's allowance.
If you look at my last post you will see we are staying with care agency and have found someone on a casual basis to fill in for now. I for one in my family think we should stick with care agency as all red tape is done by them and Mum is used to the ladies who come. We just need to top up care here and there

Yes of course I remember you Rose from the Boots Grabbit thread. That seems like a lifetime away, and London trips are just a memory. I hope you get your Carers sorted out soon.

    xx

Lovely to hear from you and hope you are bearing up well with oh. I know how hard it is.

OMG. As someone who used to do this type of thing 20 years ago can I stick my fourpence in.

You cannot get someone in and not pay them. You can't! So the person will be getting 'free accommodation' - big deal. She - I assume it will be she - will also have her own home to maintain and all the costs that involves. OK, less heating/water etc, but still, council tax, insurances etc, garden to maintain as your own home must not look unattended or it's a magnet for all the ne'er-do-wells that happen to be passing.

Whoever does this type of work cannot do it 24/7. She must have time off and must be allowed to sleep. It drives you crazy otherwise. It used to be 2 hours off in the afternoon and, if you were working night shifts as well someone must relieve you so that you can sleep. If Mum decides to get up in the night and falls over, the fact that she has a care assistant under the same roof won't prevent it. People do all kinds of irrational things and no one can prevent them. The most you can do is call the ambulance service. Health and safety will not allow you to pick up someone off the floor - danger to her, and to you (damage to your back).

I could go on. People have funny ideas about a live-in servant who will do everything, cooking, washing, caring, shopping, for a pittance and be grateful. I hated it. Thank God I don't have to do it now.

I did it through a company called ConsultUs. They may be still in business, I don't know.

The carer sleeps when the caree sleeps, that's how it is. A carer does not and should not be allowed the liberty to go off on a holiday as they have a duty 24/7. Just my humble opinion!

If you look at that link carefully, it does say that full time is considered to be 35 hours or over per week. To be officially classed as a carer and be in receipt of carers allowance, you need to care for 35 hours or more per week.

    Thus not part time.

Yes, you may care for less than 35 hours and be part time but then you also would not receive carers allowance.

Nope, I'm afraid you are completely and entirely WRONG. Allow me to help you understand, focus on the keywords in bold:

There is no specific number of hours that makes someone full or part-time, but a full-time worker will usually work 35 hours or more a week.

    The keyword is 'usually'.

Well theoretically if you are proposing that they ought to employ someone British, then even then they would require certain 'documentation' such as those checks they do if you have to work with disabled or vulnerable people ..or something I'm not sure what its called.

a CRB check isnt always necessary, but in the OP's case it is necessary.
i am classed as vulnerable, and i employ a PA. she hasnt been CRB checked, but i have known her for many years and so, it's not like employing a stranger.

Well she still has to be legally CRB checked just to let you know!

Yes and to get back to the original post. we have now found a local lady who is an ex nursing assistant who has trained in old people's care and has a current CRB cert. She knows my Mum from when Mum was a nurse which is also good. She is coming on Sat and Sun for a couple of hours to check on Mum and we are then going to call her as and when we need her. Social Services coming on 2.6 to do an assesment of Mum so we can see what they think and to ask a bit more about direct payments.
As to the care argument you get just over £60.00 per week for 35 hours a week. It can be topped up with income support if you need it but you can earn up to £100.00 per week without it affecting the carers allowance. But obviously if you work you cant get the Income support. If you need care and you dont have someone claiming carer's allowance I believe you can get something called carer's premium added to your attentance allowance. The carer's allowance is paid to the carer not the person being cared for. I know as i have claimed it for the last 4 years.

WRONG WRONG WRONG! CA can not be topped up with IS. You only get carers premium with that!
