    Thanks Robin

I have never received this pack? Does that matter?

thanks for your help. we just want to be good tenants and live peacefully in a nice home, honestly do not have any other motives! We don't make many demands at all just want to be happy and make it our home and happy to pay our rent bills etc to do this!

Its also stressing me out as I have spent all my savings and I have to pay off my debt at the agreed level as per my FCA agreement! this process seems like it may take some time... x

    UPDATE!!! this email:

Here is the attachment letter about money that is disputed over the outstanding rent & deposit that you are requesting and my requirements for the damages caused by you living there all these years, and of course any disputes that might go to court or settled in between us.

Ps. I am willing to go with you anywhere you want to go with this, just to settle this and have it all behind my back, since the day you have been a so difficult tenant, even if I have to find out about your landlord and show him all the damages pictures of the big black molds etc.., that I have only found out from you, after giving you the landlord reference letter believing that you have looked after the property so well just as you have promised. That letter should have never been issued to you, if I have known about all of this during the time you have lived there since more than 20 months ago.

    Good afternoon!!

As you are all aware that I left the UK yesterday Morning & I can't deal with all of this especially when I have been told by your husband that there were nothing he wanted from me, no outstanding rent to be paid back when you were leaving before the 03rd of august 14, that's four days prior to the end of your rent day which is the 07th of August 14. Also your husband Tim has even told that he will be claiming money from the insurance people for the time that you had to leave outside your rented property.

I can't pay you anything at the moment, as I have the right as a landlord to go through it all!! I can't even release any deposit as it was a lot of damages to the walls from so much moulds that has been caused by you!!

The bills are not an issue anymore!! I need to take my own time to gather all invoices especially by the cleaning & painting & decorating team.

I am not going to sit here & listen to any of none senses anymore. I need so much time to deal with all of this & I need time to be on top of things, especially in finding out about your insurance cash settlement and from you being staying away, due to a fire!! Once I know you didn't claim legally from the insurances about the time you had to live out of the property then I'll be more than happy to pay you back outstanding rent that was not paid by the insurance while you were away!!

The issue here is, that I can't pay something that you have already got paid for, and as landlord I have the right to know this! If you did get the money from the insurance for staying away, then all that comes not necessary & I will take my chances in court to find out the truth & let the judge decide any unlawful doing might have occurred.

Please wait till I gather all the painting & decorating & cleaning invoices from all the big huge dirt marks that you have had with living there in so many years including the moulds that needed to be scrapped completely & from being painted after.
I really need time to gather all this informations, from the builder & the cleaning team!! Once I know all of this then I will have to claim all this from your deposit!!

I will go online at the deposit protection website & put a tenant & landlord request of any future refund needed.

Please understand these things take time!! Please do not pressure me anymore & being so insisting in trying getting what I think is not rightfully yours!! I'll be more than happy to give you any of your refund deposit back & if you are claiming a refund from your rent & by law I need to go through it with the legal process as I do not trust anything done by email from you!!

Go and seek legal help & see what is right for you to obtain!! I'll do the same & we will meet in court if that is the case.

I am not going to waste anymore times with you no more as I have set & listened to you & all your requirements & needs all these long years!! I can't let you bully no more in persuading me in doing something that is not legally yours as what I think you have been doing all this years being my tenant.

I have all the invoices & proofs of any goods & damages you have made me responsible to pay all these long years passed by! This will be my final decision & in all of these circumstances from you that I don't trust, I will rather have it all tried in court so all these disputes on money from you and from me will be sorted out legally. This is all best done by the legal proceeding and best to all of us.

    Thank you.

    Kind regards,

TI have never received this pack? Does that matter?

Aha? Therefore.. My understanding is that your deposit has not been correctly protected.
So.. In addition to any other ££ a Judge may award you, you could also be in line for a payment of up to three times the amount of deposit from LL!

Tbh, there appears to be a lot more to this story than you put in your thread on HBRS.

Could you map out a time-line of the various problems you had in that flat - LL's ranting email goes on about mould and other hassles (most of the latter sound as if they'll come under 'fair wear and tear' anyway)?

Hey guys thanks for your help! Timeline seems sensible SO:

    Moved into property August 2012
Element went on the oven over Christmas 2012
Mould found in flat January 2013 (informed landlord, he blamed neighbours they confirmed no leaks so he bought Dehumidifier.
pest has entered in the house and damaged window blinds, window frames and smashed some plant pots, we are told through a gap under toilet, February 2013 ( 3 weeks to fix).
the front door handle to the flat has become very loose May 2013 (had been mentioned when we moved in)
Fridge, mattress and tiles both of which were broken when we took on tenancy became unliveable asked to replace – July 2013 (finished by end of July)
Water pump broke (20 years old), and when fixing the kitchen washing machine was broken. Without running water or machine for 3 weeks – August 2013
We then had the insurance company in who said it had been leaking for years and explained the damp issues. Industrial Dehumidifiers we paid for the electrics – August 2013

So progress. I have now received 25 emails in response to my 4 letters from the old Landlord and he has agreed to pay rent refund but nothing else>?

he has also said that we have to take him to court to get the deposit back as he will just ignore the DPS from now on.

    Frustrating much?!

No NSD went for a drink at lunch so that went out of the window.... xx

Hope you are all well xxx

  • I did 5 lots of the vouchers :o. That sounds so greedy but with 4 of us and the price of things it's not excessive. That's my story and I'm sticking to it anyway :rotfl:.

Glad you are getting settled in your new place Xx
