    Dear all,

    Well we are all moved into our beautiful new flat. I seriously think its worth every penny of the extra money. I feel happier less stressed and more focused at work.

    However, moving weekend wasn’t the stress free experience I thought it would be. We went back to our old flat to find the landlord had not only started renovation work but that he had covered all of our belongings in dirt, dust and paint.

    This included expensive bedding (that’s why we have debt!?!), TV and irreplaceable wedding items. DH took it badly and it was so upset they had used his mug and not cleaned it properly. We also went back and cleaned thoroughly (including this awful mess from the renovations) until it was sparkling. As requested we put the keys through the letter box and since then heard nothing.

    We are getting worried about our deposit back so have written a letter ready to send him (if anyone has any input would LOVE your help I could send it to you to have a read) to claim all the huge amounts of money he has of ours.

    Its so depressing because its going to make such a difference to my debt to get this money back from him, that’s what is driving me forward! Also, today is DH birthday and a NSD first of August (I hope to do much better than I did in July!!)

    Morning all, wish you could have seen me and DH today. Both in total pain with back problems, like a right old married couple!

    Hope you are all good? Doubt today will be a NSD but will try my bestest!I hope we will get a refund from insurance company of £170 but still waiting on £3k from our old Landlord!! its crazy money...

    Anyhow sure it will all be good wait until you see this letter its epic! xx

    Glad to hear move accomplished, but - did you take 'photos of LL's "works" which damaged your stuff? More importantly, please confirm this happened before your tenancy officially ended?
    If so - you've got 'im! Bang out of order.

    ..Sounds like a right !!!!!! - hate folk like that who give LLs a bad name! :mad:

    Hope you are all good? Yesterday I put £15 on my oyster card but mum gave me a tenner and that was all! amazing and yummy dinner too.

    Yes LL is foreign (I am not being rude about this!) so has not got the legal / english style of writing . He is now being rather awful. Saying he is going to take us to court with his free legal aid lawyer.. now I am not expert but surely if you own two properties you cant claim legal aid?! I am all for legal aid etc but people who abuse the system are crazy! He also might not have employment income, but surely his massive rental income counts? Plus with assets worth c£500,000 (two one bed flats in london) surely isnt not right?

    this is copied pasted his exactly one of his many emails:

    Dear ***! I know exactly who you are working for & I did all my checks now!! You do not have the right to act as agent for the company you work for as you are a tenant, Like i said if you want to claim anything in the future please do it through the legal system! Go and get a qualified lawyer & ask him to deal with me direct of my future free legal aid lawyer!! I know what you have done all these years were not right & I closed my eyes pretending that it has never ever happened just to not got through the stress but if this is exactly what you want then I rather take my chances in going through any legal proceeding in the future that you want Perdue & we both might need!! Thank you!! Yours sincerely, ***

    Its a nightmare. Doubt I will see any of this money for a long long time.

    Sparky, can you start a thread, putting a precis [sorry can't do accents over letters] of this situation on the "House Buying, Renting & Selling" board?
    There's definitely something very wrong here, and the experts on HBRS have the knowledge you need to fight this.

    I really hope you took 'photos of your possessions after ex-LL covered 'em in detritus! Preferably dated (said date being before your tenancy ended?).

    ETA: Do you have the "prescribed information" regarding your deposit (at ex-flat)?

    Ok, I see you already have a thread on HBRS - well done!

    Glad to see GM has commented - always solid gold advice from him!

    One thing. Your deposit is with DPS (I use them too).
    Your ex-LL should have given you an information pack within 30 days of taking your deposit - not just a page with details of your deposit reference number, but a whole pile of bumf / rules.

    Did you get such a bundle? If not, add that info to your thread. ;)
