Bank lost cheque and are denying ever having it.... Desperate and need help!

    Also my experience as a lloyds customer isn't the greatest so I know they aren't that reliable. They made a right mess of things with my house purchase telling me in advance that I could just go in and transfer money and then on the day that I needed to do it telling me I couldn't.

    But did they sign the v5 so do you have a name and phone number for them?

    I didn't keep any of the log book form, I now know I was supposed to keep a section of it. I just gave it with all the paperwork for the car.
    I really don't know what to do now.

    You need to ring the DVLA tomorrow as well. You can be fined for failing to notify of change in ownership

    Sorry, you mean that you did not get the buyer to fill in their details, hand them their part, and retain your part to send to the DVLA?

    Presumably you at least got the buyer to sign a receipt stating that the car was sold as seen, didn't you?

    Yes, I wrote out a 'receipt' to say that the vehicle is sold as seen without warranty, and that the buyer had had opportunity to inspect the vehicle and now takes full ownership and responsibility from that date.

    He then signed it.

    All the people I spoke with at the bank have said that the receipt is my proof, the total is three times the value of my car in 7 cheques.

    I do not have the buyers details, I will have to contact the dvla to see if they can give them to me

    To help make things clear:

    What was the total value of the cheques?
    Were they all of the same value?
    Why did you accept a cheque in the first place?

    If you are rich enough to be selling a car for £50,000 (at a guess) then I am sure you can lose £10K of it. Yes not the point but still - cancel your hose riding for the next couple of months... :P

    You would have had them, had you known what to do when selling a car. It's all written on the log book, which is why I like how boring I can be sometimes because it means I read through the document to see what's what (not to mention the car manual, so I know all the features of the car!).
    Maybe this is just an expensive lesson.

    Alternatively, call the police and report the car stolen.
    Fraud yes, but hey, you're clearly desperate.

    Perhaps to make things clear, you should re-read the post, the car was 10k, this was the cheque that has gone missing, the other cheques added to nearly double, plus the 10k cheque.... Have I lost you yet?... This would make three times the car total.. Still there?.
    There are no horse riding lessons involved..
    The cheques were different values, I accepted a cheques and was told NINE days later by the bank that it had cleared so I let the car go.

    Any way, do you have any advice?

    If they have done a full audit in the branch, surely this would have been discovered?

    Last time I paid a cheque in, I was given back a receipt which contained a smaller black and white version of the cheque for my records.

    Secondly you are required to keep the buyers address for a certain period after selling a car, until the DVLA records have been properly updated, otherwise you are liable until such time has elapsed.

    As things stand, it seems that you screwed up badly, don't have anything to work with and so the only thing you can do is put it down to experience.

    That'll be fun when he produces the advertisement, the cheque stub, and the V5 log book signed by both the seller and the buyer. The seller is more like to be done for fraud.

    Thank you, but I didn't realise that until it has been pointed out to me, I will contact the delayed and let them know about a change of keeper, but do not have the new owners details..

    Would you just 'let it go' and put it down to experience?
