Bank lost cheque and are denying ever having it.... Desperate and need help!

    I need to know what to do next in terms of the bank losing the cheque.

    Understood, but people are pointing out that the half-arsed way you've dealt with the whole transaction might still have serious repercussions.

    I think others are hoping that you'll take on board the comments so as not to leave yourself open to problems like this in the future.

    Like me, others are perhaps also wondering if your unwillingness to comply with the riles for selling a car, and your lack of records, might also suggest that you are mistaken with the details of the deposit.

    If the new owner goes through a speed trap they'll ask you who the driver is, when you say "I've no idea" they could fine you heavily, or even apply points to your own driving license.

    You could be in debt for thousands of pounds by not following proper procedure.

    Wow. OP you have been very badly treated by the bank. BUT my goodness you have so made things much much worse for yourself by the other actions you have taken during the sale of the car.
    Are you saying that buyer has never ever called you to say they would come to view the car ? If they have called you then get onto your phone company and explain why you need the number urgently.
    Other than that I really am at a loss as to who you would need to ask to act on your behalf to get the info from DVLA. The police "could" but would they as no "crime" has been committed. Other agencies have access to this data (insurance companies and the like)...but I am pretty sure you would be just laughed at by them types due to the DPA....just not worth it for anyone to give you another persons details without good reason.
    Solicitor, Private investigator goodness knows what. Sneaky way is if you know someone who has access to the Insurance database...see if car has been insured and by who....trace from there. Again illegal and someone could potentially be putting their job on the line.....Good luck though.

    Thank you, I am going to call the dvla for advise. I do take on board all the comments and am grateful that you are all responding. I am just in a state of panic and shock at the banks denial.

    Do you still have the V5 registration number? If you do then you can use that to prove that you are/were the rightful owner and then explain what happened, rather than them treating you as a stranger.
  • I have just contacted the police, they have told me that as this is an issue with the bank I have to take it to the ombudsman.
    They also suggested calling citizens advice.
  • I have all the photos of my car and the sales details, I photographed the log book previous mots all paper work etc, I may be able to zoom in on the picture and get the details.
  • The dvla are not answering and the citizens advice are too busy at the moment. I'll try both later.
    In the mean time I will see if I can contact O2 to get the call log of incoming calls and check back to see if I can contact the buyer.

    But the OP is not the rightful owner of the car. It's been sold to someone else who is now the rightful owner of the car.

    Ownership doesn't transfer until you fill out the V5 with the new owners details, signed by both parties and then sent to DVLA. It seems like the seller hasn't done this, so chances are will still be the rightful owner.

    Also note that I said "are/were", just in case the new owner has forged the sellers signature.
