Please can I ask can they send debt collectors around if there hasn't been court action taken?

No - of course they can't and they DON'T, it's all hot air and nothing has changed:

Thought you would have sussed the facts about this tedious letter chain by now - we've ignored letter chains like this for nearly a decade! If you really are so worried why haven't you merely searched the forum for 'Rossendales' and read all the other threads panicking pointlessly about these boring letters, including that letter.

It is not worth updating this thread every time another letter in the chain arrives. We have collections of letters like this ourselves (most of us anyway and there is no reason to panic). I didn't tell people every time I got a letter about my Euro Car Parks first PCN back in the day, I just laughed at each hysterical letter and filed the rubbish. There are far too many threads repeating the same old stuff about the same old letters so do search the forum and read them.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Debt collectors are powerless, if one turns tell him to foxtrot oscar! It's not likely they will send anyone, and I believe this would go to magistrates court so I don't think it will effect your credit rating if you don't cough up.

Obviously if the car has been taxed by the new keeper it's likely they had the notice to do so, and I gather you didn't , so the dvla are using sharp tactics here, and the debt collectors are just lying

Thank you for your helpful yet annoying post. I am well aware that there are many results for Googling Rossendales but what I actually did before posting was Google 'Rossendales you will be visited by debt collectort, to which I did not find any exact matches to the letter I received.

No matter, thank you for the update, I now know where I stand.

    its simple

    1) ignore the debt collectors , they cannot do anything at all, nothing

    2) its over after 6 years when the MCOL statute expires

If the DVLA claim is for the Late Licensing Penalty, it is treated as a civil debt and could end up in County Court, not Magistrates Court.

Thank you for that. As stated, I have witnesses who were with me when I sent the form...but will this not stand up? Also, would you advise I pay it then?

No don't pay it even if I thought it went to magistrates court , this is highly unlikely to go further, I haven't heard of anyone failing at court where a strong defence has been put in.

DVLA have confirmed the change of keeper from what date? How did the new keeper tax the car, on a reminder or the green V5 slip?

I will take a look and let you know...

On other matters, I read this on a different forum - very interesting:

You could refuse to pay the SORN debt of £80 by telling them that he did declare SORN (they cannot prove he did not) all he has to do is send in a SORN declaration he has no requirement under the law to chase it up with DVLA to get the confirmation letter despite what the DVLA may think about this.

A LOT of people refuse to pay these debts for SORN very few get taken to court. The DVLA generally pass on the debt to debt collection companies who you can tell to get lost. The ones who do go to court, some get the case thrown out because you have to know what legal argument to put before the judge.
