Rossendales/DVLA want £80 for odd debt?

Hi all,

I have received several letters from 'Rossendales', who are debt collectors for DVLA. I have rang them and apparently it is due to unpaid tax for a car that I sold to my friend last year. I'm 90% sure I sent off the slip to notify them of a change of ownership but, from what I can work out, they didn't receive the slip and, according to Rossendales, it is in the small print that if I do not hear from DVLA regarding the change of ownership then I should have chased this up.
I did not know this but, of course, ignorance is no defence, but it does seem harsh.

Please can I ask if anyone else has experienced this and what I can do? Should my friend have notified them that the car was SORN as soon as he received it?

Thank you for any advice. I really can't afford the £80 they are demanding.

    Just tell the DVLA that you sent the document and you are not responsible for either the postal service or indeed perhaps their incompetence in losing it.

    Its the dvla scam, you have sent it off to them via the Royal Mail so it's presumed delivered after 2 working days. They losing your mail is their problem not yours. When they send mail to you they rely on the fact that it's delivered within that period, so they can't have it both ways!

    It's highly unlikely to go to court, so I would write to the dvla with a complaint that the slip has been sent back to them, and their mail handling is not your problem.

    The users of that link are wrong in some aspects, all you need is a free proof of postage from the post office, do it on all such stuff that you may need proof that it has been sent. Legally it's presumed delivered after 2 working days unless it can be proved otherwise.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have two witnesses who witnessed me completing the slip and sending it.

    Please can I ask if this would be acceptable as a reply:

    Dear Sir/Madam,

    I have received several letters from your debt collectors 'Rossendales' regarding a supposed debt of £80. Please let me clarify to you that when I sold my car, I sent you (DVLA) the completed slip. I have two witnesses who witnessed me completing the slip and then taking it to my local Post Office and posting it the same day.

    I sent it to you via the Royal Mail so it's presumed delivered after 2 working days. The fact that you have possibly lost the slip is not my problem. Legally it is presumed delivered after 2 working days unless it can be proved otherwise.

    I do not like the tone of Rossendales' letters mentioning the possibility of goods being removed from my property or an order to instruct my employer to deduct the amount from my salary. Please stop them sending me threatening letters.

    I look forward to your reply on this matter.
    Please keep communication between us strictly by letter.



    Is there anything I should add or take out, please?

    That would do the job at this stage. The DVLA sometimes actually take people to court over this issue but don't panic, we've seen posts that show that the person shows up, tells the Judge they did send the form, and the cases are chucked out (what a waste of public money).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Besides, from a legal point of view what has that got to do with the OP?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Asking the friend if he'd received the V5 would, of course, prove that the slip had been sent off :)

    What "slip" did you send off? unless you sell it to a dealer or scrap it then you send off the V5c made out to the new keeper.

    If the car was 'off the road' when it was sold it's the sellers responsibility to sorn it....cough up

    Don't be stupid, if the car has been sold that is the end of responsibility of the new owner to tax the car, or sorn it! This is for after the car is sold!

    And this is a money saving website , if you can't offer constructive advise then go! You are not needed or wanted here!
