Don't be stupid, if the car has been sold that is the end of responsibility of the new owner to tax the car, or sorn it! This is for after the car is sold!

Probably the text in your post has got an extra word in it.
In practice though, the seller should have been concerened when he didn't get a confirmation slip after a few weeks and should have contacted the DVLA, yes it is hassle, but less hassle than what he is experiencing now, cars I have sold the slip has arrived quickly, and I'm sure many others too, it is just a small minority that incidents like the OP describes becomes a victim. He has to decide now whether to pay the penalty and get the issue resolved or let history creep back upon him in future, I know which route I would take.0 -
Yes I would know what to take as well, and that is the letter has been sent and presumed legally to be delivered after 2 working days. They lose a large number of letters in system, quite obviously there are some serious flaws in their whole setup.
And I know this true as I know quite a few people working in the dvla in quite a few positions, and I have seen at first hand where they tried the same with me, unfortunately for them I got proof from their reception staff when I visited them, they are 4 miles from where I live. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. I agree it maybe true, how true I don't know and practically I don't care, as said when I sold my last car, I scanned the signed document , took it to the post office to get a proof of postage receipt , and low and behold 2 weeks later the slip arrived to confirm I am no longer responsible for the vehicle. Too many little people want to fight the system and all it does is cause them more agro, after all the people at the dvla are just going by the records they recieved and goverment policy. later on the OP may wish to get that well required loan and it is declined because somewhere along the lines there is this history of debt collectors on his back, for me it's just not worth it for the sake of a call or two, the time taken is the same, one method is less painful than the other.0 -

My car tax ends in February, I sell the car in March......the car is already off the road when I sold it, it's therefore my responsibility to declare the car SORN because I owned the car when it made the transition......
The OP even states the car was SORN 'as soon as' his friend received it, which means the OP sold a car that was already 'off the road', which by law should have been SORNed already. We’ve had to remove your signature. You are still not getting it, he sold the car at a date, he sent off his side of the V5 to say the car is no longer in his possession. The dvla has not updated the car ownership, so they have sent him an invoice in the post to say its his fault.
Now the question to ask, is where did the renewal for the tax disc get sent to, what was the date sold, what is the date of when the car was officially off the road from.
Until the OP answers these questions the only thing we can do is speculateWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

You obviously have no clue at all how this works, your credit records cannot be hurt by debt collectors chasing an alleged debt, and even if it went to court and lost there would be no record of this at all. So stop posting misleading carp!
The fact is the DVLA must prove that they didn't receive the letter that was sent in, not the other way round, no matter how you spin it, the dvla has no chance of proving this! And the OP has witnesses to say its been sent. So as long as they are prepared to give witness statements to say that then the DVLA will have no chance in this,
As for the debt collectors, they are complete scum and should be ignored, the only people to contact is the dvla themselves, or if a claim is sent out, which they have to send a compliant letter before claim. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. So the OP says, we don't know that we are all speculating based upon what he typed, he may have had witness's , mate or not I wouldn't be taking a day off work for court, without financial compensation, and it would cost more than the £80, so from where I'm sitting, the OP's poor attitiude to the situation has or is going to cost him, even if it is just for the extra time to get this resolved inhis favour, .......all for the sake of a follow up phone call?0 -
Hi all,
I have received several letters from 'Rossendales', who are debt collectors for DVLA. I have rang them and apparently it is due to unpaid tax for a car that I sold to my friend last year. I'm 90% sure I sent off the slip to notify them of a change of ownership but, from what I can work out, they didn't receive the slip and, according to Rossendales, it is in the small print that if I do not hear from DVLA regarding the change of ownership then I should have chased this up.
I did not know this but, of course, ignorance is no defence, but it does seem harsh.
Please can I ask if anyone else has experienced this and what I can do? Should my friend have notified them that the car was SORN as soon as he received it?
Thank you for any advice. I really can't afford the £80 they are demanding.
The OP has told us already....his friend received the car and......'car was SORN as soon as he received it'..........
The OP owned when the car when the tax ran out........and in leu of that fact that he has received 'several letters' from Rossendales before bothering to resolve the situation speaks for itself. We’ve had to remove your signature. I suggest you read post #4 where he says he has witnesses! And how can you have a go at him for not reading the small print, have you read and digested every word of the small print of your PC operating system for example? If not, from where I am sitting you have an extremely poor attitude !
The fact is we don't know this person's personal situation, he could be retired, and this will be a lovely day out for him to the courts, if they proceed. Or this means very little to him and he will defend in court on moral grounds. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. And how are you working that out then? The OP hasn't actually said that! And these debt collectors also collect for the scum of the private parking industry, have you ever tried resolving something with them when they don't give a toss and only speak give us your card details! And basically will tell any lies to get those details. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
