Yes but they have not received whatever has been sent, so it's a moot point as the document has done one. The problem with the dvla is that they want it both ways, when you send something in and they lose it, it's your fault, when they send it too you it's presumed legally delivered in two working days.
They seem to think that people should get proof of postage and maybe pay for recorded delivery, but they even lose them! The point though is that they cannot prove that the form hasn't been sent. But the OP can if he has witnesses to say so.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

But if the wrong document was sent, even if the DVLA received it, it would not change the record and the OP would still be the registered keeper and why they are claiming the penalty from him.0 -
What difference would it make? The document has not been received, so even if he hadn't had sent the right one, it hasn't got to the dvla for whatever reason. DVLA = Left hand doesn't know what the right hand is doing, probably because the brain is not stored in the usual place, hence the need for miles of extra nerve fibres0

You are making assumptions here, you don't know which part of the document was sent off, I would gather it's the correct part because there were witnesses to this. The fact is the dvla lose mail, even if it stood at 0.5% that would represent 10s of thousands of pieces of mail that has gone. Which raises the point of data and the dpa, ewhich we all know that the dvla ignore the law.

Seems this has got the forum in a bit of a spin, but the real answer lies mainly with the OP, and he's not been back for 3 days now.
Makes you wonder whether he's that @rsed about it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you SO very much for all the help (Some more than others). Well I DEFINITELY can be '@rsed about it' but have had family matters to attend to over 200 miles away. I will post more details tomorrow.
