Certainly wasn't there when I signed up in 2005.

Surely the website admin needed to at minimum ask us to confirm we have read/accepted any changes to the T&Cs rather than sneak it in with no confirmation thay we have seen or even accept the change?

    No.

I am one of the people who picked up this thread after clicking on "My other half used my credit card to withdraw cash" in the weekly email.

So far nothing I've read from the OP confirms that the other half actually did this. Although it seems highly likely that the OH in question is indeed the culprit, we've only heard circumstantial evidence so far.

So... at the moment the link in the email could border on libellous, depending on whether the OP and her OH could be deemed to be identified or not, and whether he dunnit.

Either way it's not something I'd expect a trained journalist to put in an offering like the MSE weekly email. Extrapolating facts from a thread like this puts MSE on really dodgy ground.

Maybe Martin would do well to buy the latest edition of Essential Law for Journalists and make sure whoever compiles the weekly email reads it.

I'd also - like everyone here - really like to hear from the OP to ensure she's alright and safe.

Fair points but the bit about trained journalist made me chuckle.

It's as if the news of the world had never existed.

If a bank inserted such a clause into their T&Cs Martin Lewis would be kicking off big time.

Who's sneaker? The bank who gives you notice of a detrimental change or MSE who expect you to check your T&Cs every minute of every day just to ensure they're not being had over by an unpublicised change?

    Well summed up.

That is a recent addition to the T&Cs and certainly not one I ever agreed to when I signed up here. However, now I've been made aware of it I'll certainly be more mindful of anything I post in this forum.
That clause has been in the T&Cs since at least 7th June 2007 when the T&Cs page with its current address was created. I know because the Internet Wayback machine took a snapshot then:
http://web.archive.org/web/20070607171249/http://www.moneysavingexpert.com/site/terms-conditions If I knew what the name of the page was before then to look up in the archive, I'd wager that the clause was there when you signed up a couple of months earlier too.
Personally I don't think something at least 6 1/2 years old counts as recent, though you may disagree.

Come on people, it's not difficult: lose means to be unable to find, loose means not being fixed in place. So if you have a hole in your pocket you might lose your loose change.

And I became a member before that date, but I've actually been a member here since 2003 under a previous name and there definitely was no such clause in the T&Cs then.

  • I am very concerned about this woman after her last post...is there no way MSE Administrators from the Forum can try and find out that she's ok??

Unfortunately not. They don't have the time or the resources.

My point was that 6 1/2 years isn't "recent" and it really shouldn't come as a surprise to you.

I'd like to know how you know this clause definitely wasn't there when you signed up to your previous account. Are you implying that you read, inwardly digest and remember all T&Cs for all websites you have ever visited, or is it just that you can't countenance that you may be wrong? Hearsay isn't evidence.

You signed up under this account on 20th April 2007 - the one you are posting on and clicked the box that said you agreed to the terms and conditions for at the time. This is standard practice - you can only create an account if you agree to the rules of the forum. If you'd read the archive page I provided you'd have seen at the bottom it says "Posted: 19 December 2006" Which means it was included in the T&Cs that you agreed to.

I don't have the resources or inclination to prove it was there when you first joined though, as they are pretty standard T&Cs for bulletin boards worldwide, I have a strong suspicion they were. But whether they were or not is not relevant. It is without doubt provable that you did agree to them and if fault lies anywhere it lies with you not paying attention to what you were agreeing to, and it is a bit late to be indignant about it now.
