Hi there,
Can anyone confirm if an engine replacement is classified as extraordinary circumstance as I have just had my claim from thomsons denied on the grounds of they had to replace an engine thus making my flight from manchester to larnaca become delayed for over four hours.
Thank you in advance

The strict answer is: depends why it was replaced.
Read my guide to understand what the law says ECs really are about, and apply it to your own case. Then decide what to do next (again, options are described in the guide).0 -
Engine replacement in 4 hours! What were you flying in?..... a tumble dryer.0

We recently flew with BA to Heathrow, were re-routed to Manchester due to fog at Heathrow and the pilot said he didn't have enough fuel to wait in the queue for landing. We know the Glasgow flight got to land ok at Heathrow, flight sat at Manchester for nearly 3 hours (with us on board) before taking us to Heathrow. Put on later flight at 14.35 to NYC instead of our original flight at 09.50, do you think we have a worthwhile claim for this? Thanks0

Doubt it, as it was weather that caused the delay0 -
My wife and I were on an easyjet flight last year from Gatwick to Aberdeen, which was delayed by 24 hours. ( A Virgin Atlantic flight had to make an emergency landing so the runway was blocked and our flight, along with many others was cancelled) I downloaded the template for claiming compensation but unfortunately I no longer have the booking reference. Additionally we were given accommodation overnight. Do I still have any grounds for compensation?

Photoflash - no grounds as problem was not within the control of the airline concerned.0

The main problem with any potential claim, would be the reason for the delay, a runway closure, which is outside the airlines control and was because of an air traffic decision.
I think you are unlikely to be able to claim in this case, you could run your flight details through a good NWNF solicitors website, and see if they think you have a claim...
The only chink of light for me, is the length of time of the delay, did a runway closure really last for 24hours?
You need to check this and see how long the air traffic restrictions lasted.

Hi, we’ve had to remove part of your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Thanks for those replies, I know that the runway was cleared within the hour of the emergency landing, but by that time more than 6 flights had been cancelled. I think you may be right that we have no grounds for any compensation. They did put us up in the Gatwick Hilton and provide food so it wasn't all bad.
Thanks

Does anyone know the time limit for exceptional circumstances on pilot or crew taken seriously ill or dying immediately before or during a flight?
Thomson are saying my flight delay was exceptional circumstances as pilot was taken ill on previous rotation. This previous rotation being prior to a return flight from Mexico where the plane had to fly back to the UK before then flying out to Jamaica to bring us home. As these are both flights over 10hrs I presume with the change over of crew, refuelling etc this illness was over 24 hours before our flight. Have the airline not had over 24 hours to take all reasonable measures to arrange an alternative flight?0
