They should add your car reg to a white list of exempt numberplates.

    Isn't that what this means?
He's also told them my reg and that they are under no circumstances to ticket me again.

    :)
  • Yes he has already told them my reg and to never ticket me again. I know I could threaten to sue but I have bigger things happening right now so I'm just happy with it sorted

Great News. Its a bit rubbish that they didn't take your word for it and checked the CCTV.

My son is in the top DLA criteria, but at the moment is not using a wheelchair. He does need to be near the car in case he has an "Episode".

A wheelchair is not a single identifier to a persons "Special Needs"

Anyways, at least its all sorted and you know where to turn if you ever find yourself or family members in this situation in the future.

    Well Done :D

  • I can't believe it. On the 6th March I received an email from a Mr Cheakett the Meadowhall Duty Manager emailed me stating that he's told PCM to cancel any previous tickets and to never ticket me again, yet I received another today.

I called PCM only to be told they are still trying to charge me for 2 previous tickets too that were from before the 6th March. They said they have no record of Meadowhall giving them my details and that if I'm not going to pay I need to appeal on their website or by post. So I've done it online stating what I've basically just told you. I await their response.

Should I hear back from them through the post or email?

Enough! Both Meadowhall and PCM know you have protected characteristics within the meaning of the Equality Act 2010. You should now be seriously considering suing both of them for injury to feelings, as provided for in that act.

You might want to consult a solicitor, because we're not talking about getting £50 or a bunch of flowers from them, we're talking a minimum £500, possibly thousands given how persistently they are harassing you.

    http://www.pcs.org.uk/en/resources/legal_toolkit/legal_advice_from_thompsons_solicitors/

"The Court of Appeal in the case of Vento -v- Chief Constable of West Yorkshire Police, has given guidance on the assessment of damages in discrimination cases. I attach a summary of the decision. The judges stated that damages for injury to feelings can be divided into three bands:-

    a) The top band should normally be between £15,000 and £25,000 and that sums in this range should be awarded in the most serious cases, such as where there has been a lengthy campaign of discriminatory harassment.

    b) The middle band of between £5,000 and £15,000 should be used for serious cases which do not merit an award in the highest band.

    c) Awards of between £500 and £5,000 are appropriate for less serious cases, such as where the act of discrimination is an isolated or one-off occurrence."

You should get a free, no-obligation initial consultation with a solicitor.

I agree with Bazster this harassment is illegal, and you should be sending letters of not appeal but of threats to sue them for their illegal actions. I hope Daisy will pick this up as she will I'm sure have something appropriate to send in that regard.

Also get the press involved in this, they will have a field day with this!

  • I've emailed a solicitor to see if they'd help me and I've emailed Meadowhall & PCM explaining I plan on taking the matter further by talking to a solicitor. At first I was willing to let the matter die till they decided to carry on ticketing me

Don't pay for a solicitor on this, their fees are more extortionate than the parking companies.
