    Fantastic news guys. What contracts were you on (ee/orange/tmob) and we're they pre or post Oct 2012?

    I thought banana pilot was the first submission, so it's interesting to see he hasn't received a response yet. I really hope the decision is consistent for everyone.

    I have just sent an email saying that I do accept the decision... the letter seems to indicate it's either accept or reject so there isn't much more to it.

    If they act anything like T-Mobile did it will take 4 weeks (sometimes longer - yes I know) to comply with the ruling - but you get free use of the phone throughout!

    Did you get any compensation?

    Can you confirm which contract you were (feels good!) on? And did they award ant compensation?

    I was on Orange pre October 2012 - only mentions Detriment, and was awarded £100 compensation, plus backdated cancellation to 24th February.

    If you got what you want then accept. Of course you may want to wait 3 or 4 weeks whilst you use your phone for FREE and take your time to decide what sim only deal to go for;)


    Can you confirm which contract you were (feels good!) on? And did they award any compensation?

    I WAS on EE they said i will get £100 compensation. It was tge post oct t&c

    So there you have it guys and girls!

    The big companies tell you:
    • that you are wrong
    • there is nothing you can do
    • go away
    • we will not talk to you anymore.
    Ofcom say as far as they are concerned EE have complied with GC 9.6 and there is no Material Detriment

    Yet here we are with a resounding victory and £100 compensation!

    Power to the people!

    But nothing is for free...


    ...Can I ask that all those who win their cases take 5 minutes to write to [EMAIL="Lynn.parker@ofcom.or.uk"]Lynn.parker@ofcom.or.uk[/EMAIL] and copy in all or some of the media outlets in my earlier post #801, along the lines of:

    "In light of the fact that EEs change in T&Cs is of Material Detriment then EE (and brands) should have written to ALL its customers under GC 9.6 informing them of their right to a penalty free cancellation. Can she confirm that Ofcom will now enforce GC 9.6 and insist that EE contacts its customers complying fully with GC 9.6 and give them 30 days to cancel their contract penalty free as EE would have originally been required to do so under GC 9.6., and by not complying with GC 9.6 have simply protected their customer base. If Ofcom do not see this as appropriate remedy for EEs Breach of GC 9.6 can they explain what action they will take, and why have GC 9.6 in the first place?"

    So not free, but very cheap! :)
  • I received letter saying 'end of the matter' from EE, so it's off to CICAS I go. Could someone guide on how to fill out the CICAS application online as it's all a bit confusing to me !

    If the contract has ended the PAC is free an there are no termination charges (you do have to give 30 days notice). Best to give notice to cancel with 2 weeks left on the contract and then use the PAC code a day or 2 before the end of the contract.
    I won't give my 30 days notice before the end of the contract because they will use it as an excuse to charge a termination/PAC fee as they have done before...
