  • So after sending the first template email twice and never having a response I continued dealing with customer services.

I had a call back today from a rep who is apparently one under the executive office. He had seen al my other emails and seemed very clued u about what i had been saying to other reps etc.

Long and the short of it...

He said that if i wanted to persue with a cisas claim i could, but he then said is their anything else he could do to stop me leaving orange.

He is currently compiling a list of deals he can offer me on my current contract, i assume better minutes/lower cost (in his words to avoid future material detriment)

Unless it is a ridiculously good offer i will be declining and continuing with the CISAS route.

Just thought i would let you know that they must be starting to get scared!

    I am getting this right.
I received the text, sent email 1, got reply, received letter yesterday that new terms apply to pre 30/10/2012 contract only - my current contract started in December 2012.

Therefore does not apply to me.

If you got the text then cancel your contract per post #44 - simple
  • Ive sent the 1st template #44 last night, awaiting a reply,
a friend of mine who works for phones 4u has said he can get me a new contract of EE keep ur old phone and have a new phone if i receive this text.

The only offer that would be comparable is to move you onto a SIM only deal, and guarantee to you (in writing) that you will not be subject to a price increase until the end of the deal.

Anything less than the above, then CISAS is the better deal.

    @ RandomCurve

Thank you so much for your help. I'm making a Cisas claim tomorrow re: my Orange contract.

    PS
Any idea how to approach Telecoms Ombudsman re: O2 contract change? As you can see in the O2 thread we've been having problems with the Ombudsman acting as an O2 retentions department. They don't even want to acknowledge there is a problem.

I'm a small business customer of Orange (my company, one phone) who has had a couple of conversations with Orange about this - the most recent being today.

My 2 year contract began September 2012 and I've (eventually) found the relevant terms and conditions online. http://files.ee.co.uk/business/terms-and-conditions/network/Orange-Pay-Monthly-Terms-for-Small-Business.pdf

Does anyone know if this is the same as the 4.3.1 mentioned in post #44 (the first email)?

My terms and conditions don't seem to have a 2.11.2. But I did find this below and am not sure if it's relevant.

Any advice much appreciated. I did receive the text and think I am running out of time to send the first email!

Although on the subject of time to take action I did also notice this:

15.1 is relevant but I thought the clause just said "detriment" not "material detriment".

The 4.3 clause seem to be the ones referred to at post #44.

Not sure how relevant 19 is as other clauses say 30 days.
As a pre October 2012 contract the case is not so "cut and dry" (as much as these things can be when you need an adjudicator to decide), but I still think you can win a case. I will be putting up a CISAS template on the forum for those on pre October 2012 contracts in due course.

In short send the email at post #44 - if it transpires that you can't cancel then it has cost you nothing.
