EE.T-Mob.Orange. Change T&C From 26th March 2014

That letter you have posted is interesting! I'm in a position where I have a nearly ended Orange contract and a half way T-Mobile contract going.
The wording in your photo above, which you say is for Orange is different to mine for Orange ; mines says "the new terms and conditions affect all customers who joined or upgraded before 30 October 2012."
So with that logic, is it customers before 30 october or those after 30 October 2012?
The wording in your Orange letter is the exact wording in the letter for T-Mobile however.
It really is one thing after another with this mob!
If you received the Txt saying your T&Cs have changed then as long as you have sent the email at post #44 you should be able to cancel. the contract says:
"We gave You Written Notice of"
therefore it does not matter if it is implemented or not - you have received written notice. additionally EE clearly state elsewhere in the contract that they the can use text as a notification method so they have already given you grounds to cancel.
They are now trying to wriggle out of the mess they have created and I would not be surprised if Ofcom stepped in to help them out (I have been in contact with Ofcom since early Feb and they are saying that the change is not of material detriment - I have of course challenged them on that and am awaiting a response).
I think I mentioned somewhere at the beginning of this process that you will find out just how corrupt the system is, well it seems we are about to find out!0 -

I've popped the email off to them ; time for round 2!
In terms of finding out the level of corruption? It's certainly looking that way.Currently in a Protected Trust Deed - 23 payments until DEBT FREE - February 20270 -
Thanks RandomCurve. I have just submitted my cisas application. Will update this thread for any responses.0

I will try and post up a case later tonight/tomorrow (it is written but I need to check some cross references.
Do you think we should wait for week since last email I sent said If not get cancellation then will start CISAS application? or should I just go ahead with Application.
2) when we say Appendix 2 shall we state my first email to EE, Appendix 3 EE reply to appendix 2 and so on?
Thanks again for your help0 -
Normally takes upto 6 weeks. However cisas do tend to favour the provider on more occasions. You may also need to be open to raise a small claim in the end if needed.
The longer it takes for the process the more you will be using the current EE contract and if a decision goes in your favour then that means you have used the contract free during this period as EE will need to pay you out since you put in your notice to leave. Therefore you need to hurry to put in your notice if not already done so.
It's also not economical for EE to contest a small claim as getting legal representation for the court will cost them a lot more than settling the claim out of court. Also they wouldn't want a decision to go against them. So it is very much possible to make EE pay for the trouble they are putting us through.
The more of us that act the better.
Sorry I've taken so long to reply!
Hi @sshariff, Thank you for responding to my inquiry so quickly.
Hi @RandomCurve, Thank you for sharing the templates with us. Just sent my first email post #44 to Mr Swantee and the executive office and let's wait and see what they will say regarding the changes to terms and the penalty free cancellation request.
Also I just checked T mobile website again and the terms and conditions part still stating this
"Who is affected by the new terms?
The new terms and conditions affect all customers who joined or upgraded to a T-Mobile plan on or after 30 October 2012 and before 23 January 2014."
Hi @patel1977, one of my lines with Tmobile is also due to end this year May. So far I only seek to terminate the 2 years contract I took out last year June as I have no intention to keep the line which will end this year as thus the potential price rise should not be a problem to the soon will be gone number. It is entirely up to you (and maybe how much you are paying / will have to pay to EE), after all really. :beer:0 -

It's quite normal for forums not to allow links for new users, nothing personal

Thanks Simon & Ipyy
It's so stupid that tmobile have 2 contradicting "who's affected" sections for the t&c's change on two separate web pages, within the same website!?0 -
CISAS complaint filled in online and all emails etc have been submitted by email.
If you submit evidence by email don't forget to include the reference number you are given when you submit the complaint
It also says on the CISAS website that they only accept .doc .jpg and .pdf files so don't forget, if you are using a new version of Word, to save them as a Word 97-2003 document. The new version saves them as .docx by default0
