Hi I received a letter today about changes to terms and conditions. I have two contracts with Orange/EE one expires in July 2014 and the other in March 2015. What's the best plan of action with this. I would like to cancel both contracts but as my second one has over a year left on it don't want to owe anything or for my credit rating to be affected. Can I just cancel the contracts or do I have to wait until they actually put the prices up? Any advice happily accepted as my teenager needs a new phone with a better deal!!0

With regards to the right to cancel without penalty

7.2.3.3. The change that We gave You Written Notice of in point 7.1.4 is:
(i) an increase in Your Price Plan Charge (as a percentage) higher than any increase in the retail price index (also calculated as a percentage) or any other statistical measure of inflation published by any government body authorised to publish measures of inflation from time to time, and published on a date as close as reasonably possible before the date on which We send You Written Notice; and
New:
7.2.3.3. We have given You Written Notice of an increase in a Price Plan Charge under point 7.1.4 and (i) the increase in Your Price Plan Charge (as a percentage) is higher than the annual percentage increase in the Retail Price Index (RPI) published by the Office for National Statistics (calculated using the most recently published RPI figure before we give you Written Notice under 7.1.4);
CPI is recognised as a better measure of inflation and is consistently under that of RPI. Currently EE could increase by no higher than 1.9% (CPI), however after this change they can increase by 2.9% (RPI). Thus I believe this change of terms and conditions is of material detriment to me.
I'm sending them a letter to that effect.
My main reason is that i'm aggrieved that as an early customer i'm tied in to another 7 months of a 2 year contract at £46 per month when I can get double speed, more data and international roaming now for £27 a month.0 -

So the EE dirty tricks machine has swung into action!
EE have now realised that you CANcancel your contract and have gone into damage limitation mode.
The letter they have sent (above) has been written incorrectly and the website is the version they meant to send.
They are going to try and wriggle out of this by claiming that DUE TO AN ADMINISTRATIVE ERROR ON THEIR PART changes to T&Cs were sent to all customers when only those on pre October 2012 should have received them - they are a real nasty bunch of vipers!
They will probably write to you apologising and may (although I doubt it)offer you a £5 of £10 credit on your next bill as way of a sorry. DO NOT ACCEPT THAT.
You T&Cs are clear that if THEY "NOTIFY YOU OF A CHANGE TO T&Cs", you can cancel, it says NOTHING about the T&Cs being implemented.
The complication will come for anybody who never took the advice of "Don't Delay Cancel Today". If you have already sent email one then CISAS should just be a formality and you'll get the penalty free cancellation (no guarantees here don't forget).
For those yet to send the first email EE will claim that they had already rescinded (withdrawn) the change, however as you have 30 days to accept the change or not you may be able to validly argue that they can't rescind it until the 30 days is up. In any case you are blissfully unaware that hey have withdrawn it as the letter says that it does affect you!!!
My advice SEND THE CANCELLATION EMAIL at post #44 TO EE IMMEDIATELY (whatever T&Cs you are on).

Right I am confused again!!
I signed up to T-Mobile (through a 3rd partywebsite) just before Christmas. Nowhere in the package I received containing my new phone and sim card did it state the T&C's that I had signed up to. I therefore went to the T-Mobile website (http://www.t-mobile.co.uk/shop/terms-and-conditions/terms/) and downloaded the T&C's that were there entitled:

However looking at the proposed new T&C’s coming in from 26th March 2014 (http://e-gain.s3.amazonaws.com/external/content/Ts%20and%20Cs/TMUK_PAYM_TERMS_V58C.pdf) it states it is:
By this logic I would of thought that the actual version I signed up with would have been 58B?!? Does anybody have a copy of this version? Does it exist? Why would they number a newer version of the T&C's with a lower number??
Also in relation to the new terms and conditions on the T-Mobile website (http://help.ee.co.uk/system/selfservice.controller?CONFIGURATION=1016&PARTITION_ID=1&secureFlag=false&segment=consumer&TIMEZONE_OFFSET&CMD=VIEW_ARTICLE&ARTICLE_ID=3596939&CUSTOM_BRAND=TM#) it states that:
Yet there is a clear detrimental change to the wording of 7.2.3.3 between version 59 (dated Oct 2012) and 58C (dated March 2014)! So how can they say only those who upgraded before Oct 2012 are affected????
Don't worry about the numbering of their T&Cs it is just their way of tracking "wholesale changes" applicable to all new customers (e.g. moved from V58 to V59) and changes to T&Cs that only affect current customers.
You will be on V59 so if you received the change to T&Cs text you are on to a winner as you should be able to cancel penalty free and then go SIM only elsewhere - you get to keep your phone for what will be effectively 2 or 3 months worth of contract payments (I had exactly the same "win" last year!!!)

Anther hobby horse of mine - I have asked Ofcom to explain why they allowed EE to go to market with 4G 10 months earlier than everyone else AND allowed them to charge almost twice as much as they do now there is competition.
Ofcom are supposed to protect US not them - what a joke!0 -

I have sent the first two emails and received their standard responses. I sent the third email on Monday and haven't yet had a response. Although as they have indicated in email response number 2 that they "refer the right not to enter further discussion" I assume I can just send the email you produced in post #222 without the need of a reply to my third email?
By the way I did receive the text notifying me of the change to t&c's however I no longer have it on my phone (it was deleted). Will this be a problem?

I don't think the deletion will be an issue, they are hardly likely to deny sending it given it was on enough websites.0 -
Given the latest developments from EE I think those who have received the "this is our final word email" we should change tactics and go straight to CISAS.
I will try and post up a case later tonight/tomorrow (it is written but I need to check some cross references.0
