;65449837]Hi all,

I lost my claim against the Tmobile/EE and decided to go for the SCC. I just received a reply from the company regarding my "letter before action" email sent a few days ago. I, somehow attached my CISAS case number in the "letter before action" email, not the case Reference given by the company (Silly me). I've replied to the company with my case references and mobile number. So now I am just waiting for their final response on this matter.

There is just one thing which makes me quite concerned, in the email I received it said that the company had ran a search of my name in both the PAYG and Pay monthly databases but they cannot locate my details/ account?!! And I always contacted them using emails, so somehow I cannot understand why they said they were unable to track the details.
Giving them the phone numbers should be sufficient. Unless it is another crude attempt to fob you off.

Adjudicator assigned... Miss Justine Mensa-Bonsu. Haven't seen her name mentioned anywhere before?

Chances are they'll switch to a different adjudicator.

One of my claims had someone that hadn't been used, then they changed it a day later to another adjudicator who had previously been used.

Thanks g6jns.
I only provided the CISAS reference in the "letter before action" email (silly me). But I am concerned as they said that they cannot locate my account/details using my name in both PAYG and Pay monthly databases. Moreover, they should be able to find (and I truly believe that they know they can find) the details through conducting a search of all our previous conversations using my email address (should be only 3 or 4 emails in total as I only contacted them for penalty free cancellation).
Never mind, I've just replied them with all cases references given by the company and the mobile number I wish to cancel. And hope that I will hear some good news within 7 days.

Hi, cannot believe this has happened!!!

Just received a reply from the executive office:
Thank you for your email response.

We do not feel that this change is of material detriment to you as it is in line with the Retail Price Index (RPI), which is a measure of inflation. I acknowledge you do not agree with this decision therefore the next step would be to seek independent adjudication via CISAS.

You may refer your complaint to CISAS. CISAS will determine whether the complaint falls within the jurisdiction of its ADR Scheme. We may argue that it does not. If CISAS agrees its Scheme applies, it will adjudicate on the complaint in line with the Scheme rules. CISAS's details are as follows:-

CISAS
International Dispute Resolution Centre
70 Fleet Street,
London,
EC4Y 1EU
In my reply to the email I received today I have included my references numbers/account number/mobile number, AND forwarded my "letter before action" email to them again (as appendix in the reply) to tell them that I lost in CISAS and now wish to go for the SCC. Did they actually read what I sent???

Do I need to send them another email to say that I already lost in CISAS, attached my CISAS case again for them to review, state my intention to go to SCC,and then give them another 7 days to work things out? or I simply reply to them with one sentence "I lost in CISAS, and now wish to to for SCC" will be fine?
Please go to #1600 for more information. And I already lost in CISAS and the "letter before action" is to tell them that I will go to SCC, not CISAS.

Hi Nodding Donkey,
Thanks. Actually all of them. HAHA.
In my reply to their email I've attached the "letter before action", and asked them to read the forwarded emails to gain more information. If they did, they will notice immediately that I already went for CISAS before.

Just go straight to SCC, you have given Tmobile advanced notice, if they want to play games thats up to them, as long as you have proof of letter before action and CISAS claim then should be no problem.

Hi Boatman, RandomCurve, Thank you for all your help.

Honestly I really do not know what to do at the moment. I really do not like the ideas of sending them another email regarding this matter as I've already given my notice and it is them who decided to ignore what I actually wrote/sent.
Right now, I am just not sure whether I should go straight to SCC, or like RC said to go back to CISAS, as we seem to have reached a deadlock again?...

If go to SCC, What my chances are of winning this case??

I appreciate any help.
