Why are people not suing EE?

Because it wouldn't stand up in court - despite the fact that EE are knowingly doing things incorrectly !!
Small claims court - yes !

I used the templated posted in #744, I think it was. The reply I got was:
    "Thank you for your email.

I confirm your account was disconnected on 29 April 2014 due to porting out to another provider. A final bill will be generated and sent to you to confirm the account closure.

I trust the above information is of assistance to you.

    Yours sincerely

    Victoria Hunt"

So, basically, they've ignored everything that was said in my email.

We received an email this morning with the PAC Code for both our numbers.

Just waiting for the compensation and refund now :)

Thanks to RC and everyone who has helped on the thread.
Remember your contract isn't cancelled until you have used the PAC so I wouldn't expect the refund/compensation until after that.

If you have been copying in Ofcom and EE have still ignored you then if it has been 8 weeks go to CISAS and change the compensation rationale to read - EEs total lack of response to my emails and recorded delivery letters £100.

On that note then, my contract were taken out in 2013, when I start the CISAS application process which templates should I follow.

Use posts #1477 and #1478 and the amendment to #1478 which is at #1479.

Received my defence yesterday and have sent my response using the above posts. It is quite confusing but a bit of time and effort reading up and double checking everything is well worth it.
Thanks go to RandomCurve and everyone else who has given help. I will update as soon as i have any news to update :)

Simply that the Court expects people to use the CISAS route first. A small claims action will usually be rejected if this not done first.

Looks lie I'll be contacting CISAS too. Can someone please point me in the direction in this thread of where I'd find templates, etc on what to write? Thanks.

  • Hi all,

I lost my claim against the Tmobile/EE and decided to go for the SCC. I just received a reply from the company regarding my "letter before action" email sent a few days ago. I, somehow attached my CISAS case number in the "letter before action" email, not the case Reference given by the company (Silly me). I've replied to the company with my case references and mobile number. So now I am just waiting for their final response on this matter.

There is just one thing which makes me quite concerned, in the email I received it said that the company had ran a search of my name in both the PAYG and Pay monthly databases but they cannot locate my details/ account?!! And I always contacted them using emails, so somehow I cannot understand why they said they were unable to track the details.
