    Claimants need to understand that the role of the adjudicator is to make a decision based on the evidence they are given. Also they have to remain neutral. In other words they are not on the side of the claimant or EE. Unfortunately if the claimant does not put the case correctly then it will fail. It is not the adjudicator's role to consider similar cases or decisions just the evidence in front of them. That is why it is important to follow the fantastic work done by RC and his instructions carefully. This may sound harsh but it is true. Good luck with your claims and again thanks to RC for his efforts. I hope he will press the case with his MP to get OFCOM to do their job properly.

    Received my decision today...... Complete success :D
    Penalty free cancellation backdated to February 2014 and compensation of £100 for lack of duty of care.

    Adjudicator was Vidette Ogden. Absolutely delighted!!!

    My contract was taken with T-mobile march 2013
    Currently in a Protected Trust Deed - 23 payments until DEBT FREE - February 2027

  • Update on pac code etc, i just spent 30 mins on the phone to EE.
    I got the impression, they are in a right mess, nothing has been updated on my account to say what they have been instructed by CISAS. All that was on my account, is that they have instructed me to go to CISAS, (something they did 2 weeks ago, after i had won my case).
    I'll let you know the update tomorrow, seems we have completely thrown them :D

    Hi RC - Quick update for you, as I said I sent the BEFORE ACTION email even though I decided not to pursue.


    Today I got an email from EE,




    Without Prejudice Save As To Costs
    Was the title of the email, they have agreed to cancel my contracts from now, no compensation or backdated payments, but I am amazed within 24 hours a response at all, let alone this.


    YAY,


    I accepted and she replied to confirm I have now cancelled your account.


    So thank you again.


    Now just my Orange price increase to pursue on the other thread.

    Fantastic news - normally they make you submit a case and risk £35 and then back down the day before they have to submit a defence - I think they know they are on to a loser here as their email said "Save as to costs".


    I also suspect (or hope) that the price forum has swamped them so much - and they have so much more to lose - that they want to concentrate on that rather than "playing" games with you re the SCC.


    Anybody else who lost at CISAS - may be worth following this route too. Brilliant

    Honestly don't rush them - rather email Ofcom (copy in EE) Saying:


    CISAS awarded me X and EE had to comply by DATE - they are now late - will you take action? And if not why not?


    Just resend every week - updating the time , but Don't copy EE into the subsequent emails to Ofcom :)
    By doing the above EE have had notice, Ofcom can't hide behind not knowing, and you extended free use of the phone.
