Notice of assignment of debt from civil enforcement regarding a PCN issued May 2012!

Back in May 2012 my husband received a private car parking fine from Civil Enforcement Ltd, he wasn't liable as he wasn't driving (this was prior to the change in law). I got some good advice here and we informed them that he wasn't driving the vehicle and then ignored all further correspondence from them.

We had forgotten all about it until a letter today stating they have "assigned part of the above debt to Debt Enforcement & Action Ltd" and that they will no longer be involved.

Is this right? Surely he's not liable to pay? Back in 2012 the advice was to ignore everything, but that advice seems to have changed quite a bit.

I suffer from anxiety anyway and this letter literally made me feel sick.

Any advice would be very welcome.

    Unfortunately that is exactly the effect that they want this letter to have on people, it's just another bullying tactic to try to get money out of you for a "debt" that doesn't exist.

    You owe them nothing, there is no debt, no effect on your credit rating.

    Stay strong, continue to ignore and beat the bullies.

    Love to know how you assign a debt without an agreement or a contract?

    What a tacky name who dreams them up? "Debt Enforcement & Action Ltd"

    Maybe their first action should be reading debt purchase or assignment legislation.

  • Ok, thank you. I thought this had all gone away, it was a really horrible feeling reading the letter. But you're right, he's not liable, therefore he doesn't owe them anything. Would you continue to ignore them? This isn't a request for payment, it's merely informing me that they've shifted the debt to this other company (who have a remarkably similar name to the original company).
  • I got one of those letters today as well. My 'crime' was committed early in 2012.

    Ignore them but please post up a pic of these letters so we can see them, to advise other newbies. Sounds like there may be grounds to report this firm (e.g. if the letters that start arriving are misleading and if the company is actually connected to CEL). Should be interesting - and nothing to worry about.

  • On the subject of CEL there was a thread on Pepipoo where the OP was close to a court date with them. Does anyone have a link to the case. Money was on it becoming one of the two no-shows Prankster needed to swing into action.
    Celeste, You may like to know that on the rare occasion CEL push as far as court papers they almost invariably withdraw at the last.

    If they assigned the debt to this new mob, CEL won't be doing court and you have no contract with the debt collectors.
