I got the same court action from DEAL so e mailed co-op got a lovely standard reply.
Thank you for contacting Steve Murrells with regards to the correspondence you have received relating to a parking charge. He has asked that I respond on his behalf. Firstly, may I apologise that this has been received as a result of parking in one of our car parks and for the delay in contacting you.
As with many other retailers, parking controls at our stores are managed by third party companies and the collection of parking charges is their responsibility. They have erected numerous signs in the car parks they control which provide details of the restrictions that are in force.
The Co-operative Group appointed these companies to address the very serious issue of customers overstaying in our car parks and we did not take this decision lightly. I do understand that the letter does not contain much information.
Unfortunately, we are unable to intervene at this stage and you will need to contact Civil Enforcement directly at the following address:

I do understand that receiving a Parking Charge is frustrating. I also understand that you may feel that the Co-operative have let you down in resolving parking issues at this Store through Civil Enforcement. However, I would reiterate that the current agreement in place with Civil enforcement means that we cannot intervene on your behalf. I regret to conclude that we can be of no further assistance in this matter.0 -
And yet the Co-op used to pay them all off, only a few months ago, as I am sure you've read in the Parking Prankster's Blog and on any Co-op thread from late 2013 or Jan/Feb this year. So it has to be a LIE to say 'However, I would reiterate that the current agreement in place with Civil enforcement means that we cannot intervene on your behalf.' If it were me I would write back and point out they are lying because you know they can and did step in and pay off the early complainants by sending out cheques all over the place - they even sent cheques up front before the customers had even dealt with CEL and even where there was no court claim.
You'll find threads about this linked in 'Successful Complaints about PPCs' a sticky thread I have kept up to date (it's in Crabman's 'parking forum stickies' near the top).
I would write back and say this U-turn makes consumers on MSE forum (tens of thousands of people) believe the Co-op's Legal Dept are trying to cover this up. It does the Co-op no favours to be quoted on forums as lying about the true situation. It was the Co-op's own fault - if you lie down with dogs, you get up with fleas and that should have been obvious. Instead, the Co-op believed the spiel of the parking firms who promised to 'police the car parks for free'. Who exactly did the Co-op think would pay for this 'service' since you don't get 'owt for nowt? And why did they (at the very least) not retain responsibility for deciding and having the final clout about who could be sued and when. It seems that the Co-op allowed CEL to have a clause in their contract that allows CEL to sue anyone, whenever they choose, which could be for another six years, in contract law. This will be a time long after the shopper has kept any paperwork and what would they do if this was their elderly parent, brother, sister or adult child getting these ridiculous letters and court claims?
The Co-op deserve to be sued about this issue, and they deserve the terrible publicity that should be coming their way about it (same as Morrisons with ParkingEye, who are also unable to stop PE suing people but write letters telling their customers, 'it's alright, if you pay PE £60 as they are out of pocket, it will be cancelled') as if that's OK in a letter to a customer.

I agree with CM, disinformation, distortion and dissemblance. You really need to take this further.
If you are a member of the Consumers; Association take this up with them, also get in touch with your local radio station, newspaper, Chamber of Commerce, and Trading Standards Department, write to your MP. Complain to The british Retail Consortium

The confirmation that you employed and continue to employ Civil Enforcement Ltd is very helpful
I note your comment that your current agreement means that you cannot intervene.
Could you confirm please that this is specifically stated in the contract ?
My understanding is that a Principal is able to intervene in an Agent's action unless the contract says otherwise
If this is not in your direct knowledge, who in your organisation can provide the information ?
The legal capacity of Civil Enforcement Ltd will be central to my defence in the event of legal action
In the event of a hearing, this would save the inconvenience of a witness summons which, in the absence of a Company Secretary for Co-operative Group Ltd, would have to be served on Mr Murrells personally

Well, all this talk of ignoring... I found out by chance when looking at my credit report that Debt Enforcement & Action Ltd. took out a CCJ on me. The annoying thing is that it will stay on my credit file for 6 years. They cannot provide me with proof that I did not pay for the parking in a supermarket multi-storey, I'm certain I did, and the last two important letters of correspondence regarding court proceedings were sent to my previous address so I never got to see them. I found out by Northampton Bulk Claims Court that the letters were returned by the tenant there as "not known at address" and they subsequently informed Debt Enforcement & Action Ltd (which I suppose did nothing).
Regardless, I have a CCJ as I never got two essential letters as they went to a previous address. I never saw this coming and largely because some people on here advised to ignore the original letters due to being private land etc. etc.
I now find my credit rating shot to pieces because of a CCJ Debt Enforcement & Action Ltd have enforced. Needed a car recently, nope, declined. Need to rent somewhere different soon also...
My advice? Just look after yourself by picking up with these companies the moment you hear from them. You can always contest early on requesting proof. I cannot do that now as it has gone too far without my correspondence (the latter two of which I had no option).0 -
Please start your own thread and we will help you get this expunged.
However, this is not really an area in which you should be looking to save money. My advice would be to place the matter in the hands of a reputable credit repair company. If CEL/DVLA/DEAL have acted inappropriately, (and CEL/DEAL usually do) it need not cost you a penny.

Hi all
After reading these posts If you do want to communicate with these people from what I've read the only question that should be asked is
"Where is the signed document that states someone owes you money and if its not produced this letter and any others that may come will be treat as harrassment and will require further action at my expense which may be recovered from yourselves?"
if a debt collection company cannot provide this then as you have asked they should stop sending letters immediately.0
