EBAY - debt collectors letter - I won't pay!!

To cut a long story short - I sold a coat on ebay - the buyer moaned about it and ebay told her to return it for a refund - ebay refunded her and she sent a recorded delivery parcel to me BUT IT DID NOT have my coat in it,2 other random jackets instead - they now want the money off me but I refuse as I haven't got my coat back. We're going round in circles and now I have this debt letter -any advice???

    Who is 'they'? You mean ebay (or a debt collection company that Ebay sold the debt to)?

    sorry. Ebay wanted the money off me at first but have now shut down my account and passed it to the debt collectors - I received a letter from them yesterday

    The coat I sold was a BARBOUR one, so not a cheap one - the amount in question is £58.47
  • I think you are on to a loser here. The buyer has proof of postage, you cannot prove they did not send you the correct item back. The question is, how much do you value your credit rating? Ultimately you could end up with a CCJ.

    What did the buyer say when you questioned them about the jacket? It's actually theft, but you might be onto a loser here.

    I phoned ebay immediately and as requested sent photos of the package as it was opened - why should I pay £58.47 for an injustice - I just won't do it!

    the buyer knows what she has done as she wanted a partial refund at first - I think she was hoping to get the coat cheaper but after complaining, Ebay told her to return it for a full refund - not what she's hoped for so she obviously chose to keep it and pretend she'd returned it

    I hate thevies with a passion.....i would fight it all the way. If this goes as far as a CCJ i would be at that court fighting my corner.
    Do you have the reciept from the post office with the weight of the parcel you sent? Do you still have the packaging for the parcel you recieved? Is there a weight difference?

    Good for you! Call the debt collector and tell them that you will relish your day in court and you will win, it will never happen but at least they will know they can't give you the usual court threats as ultimately they have nowhere to go.
