EBAY - debt collectors letter - I won't pay!!

    Thank goodness someone is with me on this Poppie and Jim - it's my first time on here as I'm desperate for some support - I will fight all the way even if I end up in jail as I simply CANNOT and WILL NOT pay this thief !!! Hadn't thought of checking the weight Poppie but will have a look at receipts etc

    these people are the scum of the earth

    i had one once who sent me an empty envelope signed for knowing id have to sign for it then ripped me off

    hopw u follow it through :)

    we are all with u but dont know if it will be too much as the establishment always win :(

    Do you have the reciept from the post office with the weight of the parcel you sent? Do you still have the packaging for the parcel you recieved? Is there a weight difference?

    OH MY GOODNESS Poppie you might just have saved my life!! I have my PO receipt with her postcode on when i sent it to her originally - the weight is 0.65kg, I had the SAME packaging that I used returned to me with 2 jackets in - that all weighs 1.07kg. There is tracking details on the Royal Mail website about it but doesn't state the weight, I have emailed them and will phone tomorrow too to ask about the weight of her parcel - so excited now and fingers crossed more than ever now!!

    I think you are doing this wrong.

    You should be sending a letter before action to the buyer telling her to return the correct coat or pay you the money back within 14 days, otherwise you will take her to court.

    It can be done via the only claims court and she would pay costs.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    She has been given that opportunity several times - she keeps saying she HAS returned my coat - the small claims court will cost me and I won't pay a penny when i'm not in the wrong. She is the thief and the liar and now she must pay face the consequences

    Then you won't win.

    All your court costs will be recovered when you do win.

    She won't face any consequences if you simply refuse to pay the debt. She's already got her money back from Ebay. She'll never know whether or not you successfully defend yourself against the debt collectors.
  • OK, OP we understand. But pipe down a moment, so that those around the parish can give you good advise. If you go all guns blazing, it will gather the n u m p ties.


    So as we understand, you sold a coat on eBay, and the customer wanted a refund. eBay refunded, but you received two differing coats back. eBay has closed the case, as it refunded the customer.

    Are you a private or business seller?


    How much do you value your credibility against the original cost.


    Remember, it is no good just closing an account, when, if what you have posted, a theft, or fraud has been committed.

    She won't face any consequences if you simply refuse to pay the debt. She's already got her money back from Ebay. She'll never know whether or not you successfully defend yourself against the debt collectors.

    True - although I managed to track her down on FB and have told her whats been happening but not the latest news. I've also been in contact with the CEO of Ebay who are also looking in to the whole matter - when I tell them of the latest news they will have to deal with her then
