So to save you going off track.
If you were the CEO of eBay(who isnt doing anything)
How would you decide who is telling the truth?

Well I would look at all the facts of the case which others haven't first of all. I didn't have proof before now so it would be my word against hers so it wouldn't be a fair trial to favour one without proof. Then there's a degree of common sense to add. I can't believe the negative comments being received now, where is everyone's fight for injustice and belief in oneself when they know they are right? Never give in to bullies, always fight for what you believe in

Tell us about the initial issue. You say she moaned, but what exactly happened. I'd like to hear both sides.

Thank you for asking but I am tired and drained now, there was positivity earlier now it's gone so I will leave here now. I will win as I am not in the wrong as well as the fact that I am not the thief here. Thanks for your interest

    Please describe your proof.

As I see it, you got your packaging back, and you've weighed it with the crap jackets and it weighs more.

    It doesn't prove anything.

I agree. Even if she the seller produces a RM receipt with a greater weight, you have nothing to prove your jacket was not part of that package.

The buyer has won, she has her money back. You need to deal with the debt collector, and should you wish to, pursue the buyer through small claims. The two are distinct issues.

Many people have went through court thinking the same thing, only to lose.

With court, its not about who's telling the truth. Its about what you can prove - although thankfully the "proof" required for small claims is not the same as criminal court. I've even witnessed cases where dozens of legal experts have said its a win yet the presiding judge disagreed.

Small claims you only really need to convince a judge that its what happened on the balance of probabilities.

However, you're missing the point completely. Most people who have replied seem to agree with you fighting it. They just think you're going about it the wrong way.

There have been developments just now from the buyer which I won't go into, but I know she knows what she has done is wrong and I feel this will now be resolved. Call it guilty or realisation that I won't give in but I'm saying no more apart from I HAVE won and I was always positive that I would

I have no idea if the weight issue will help you are not..it helped my MIL win a case with EBAY when a buyer claimed all she recieved was an empty Wii box and opened a case against her and sent the box back to her. EBAY sided with my MIL when she produced her reciept and the return packaging that had the weight stamped on it. Sorry if it does'nt help you in this matter, just thought it might help.
I know it's not very MSE but i would rather spend more money fighting it than letting a thief get away with something.
Good luck anyway in what ever you choose to do.

EDIT: just read your last post...well done, hope you get the matter resolved.
