    You will need our help as this is the new appeals stage (not POPLA, as you've seen). But you can use the usual first appeal versions in the Newbies thread, just change the end to ask for 'details of any independent appeals procedure' rather than demanding a POPLA code like most people do with the other PPCs.

    If they reply asking for who the driver is, do NOT tell them, come back here.

    The independent appeals are heard by the "barrister" at the law firm listed as next door to the IPC, which appears to be a interconnecting office with the one next door.
    In short it looks like you appeal to the trade club they are in.

    What contract did you get with this space and what does it say with regards to permits, does it "convey" the conditions forward in your contract, for your contract will trump any stuck on a wall.

    I would give the invoice to the company you pay for the spot and ask the !!!!!! they think they are playing at.

    Ahh

    I don't have a "contract" at all. It was listed on a parking space website and then send me a new permit every 6 months (last one was issued for 12 months) and I pay via standing order

    Just heading to bed as I have a 5.30 start but will be back on around 9ish

    I agree, they are the first port of call as regards a complaint, especially as the OP paid for that permit and C2C are pretending it's the wrong colour or summat!

    And just to remind the OP not to imply who was driving in any appeal (so not 'I parked' and not 'my permit').

    If you have paid your fee and got a permit, just why is it 'invalid'? And if you know who you pay and contacted to arrange parking initially, then get on to them pdq.

    As the OP has only just received the windscreen ticket -

    1. Can the OP get a photograph of any signage at the premises and upload?

    2. Would the OP be prepared to show us the FCN (redacting ALL personal info -eg. FCN number, Car Reg etc NOT REQUIRED). - it would be interesting to see what their ticket says regarding the appeals process - we have already seen signage with the BPA still on it.

    Also be wary of submitting the appeal on-line as they require a tick box consent that should your appeal fail, then you authorise them to commence legal proceedings against you. Whilst this is nonsense as anyone can instigate court proceedings for an alleged debt, the motives behind this may be misconstrued by a district court judge and twisted against you. This is especially important as whilst Capital2Coast were beaten at POPLA - we have not had a case using IPC's system. Plus the director of IPC is also the director of Gladstones solictors which are used by the PPCs and they already deal with PCN(NW)Ltd court cases.

  • Yes I had a nosey around their appeals page.

    I found it odd that they are asking me to upload photo's when they say they already have them.

    Either way I assume I am still to follow previous advice before going via the appeals page? (i.e. talk to who I pay permit cost to and then send the first appeal?

    If you send your appeal in via snail mail then you won't be having to tick 'please take me to court' nonsense box as per their (and all other IPC members') online system. Send it with free proof of posting from the PO - don't bother with 'Signed For', some PPCs won't sign for it and your appeal won't be received.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I just spoke to the lady who I deal with over the rental of the space and she is livid! She's calling them now and said she'll ring me back shortly.

    Take it I don't need to appeal if she gets it sorted?
