Make sure she gets the cancellation in writing for you though.

  • She's emailed them (rather angrily) and copied me in so fingers crossed we will get an email back.

Is an email enough or will this need to be in letter format?

  • Tis better in letter, cos it costs them money!!
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
  • Ha!

    good point!

I'll ask for written confirmation by post if that's the case.

    :)

  • Update - they didn't reply yesterday. I've emailed my lady to let her know I will be writing and sending the letter if they don't come back to us today because after reading various threads they are probably just stalling.

They're probably busy photoshopping my permit out of their photo's!

If you rent a piece of land, does it make it your property?

If so, it would be nice to think that you might raise a claim against them for pursuing an unauthorized business on your property.

    (Just whimsically thinking aloud.)

That's precisely what happened in Davey vs UKPC as I recall. ;)
  • Got an email back from my woman.

She said "yes feel free to start a proper complaints procedure - they are useless are replying to us"

    Says it all really!

Been through all of the first appeal examples now but they are so vastly different because I haven't received a NtK. I just have the Fixed Penalty Charge, and so I can't have a go at them for whatever ridiculous statements and lies they would write in the NtK.

Should I just keep it fairly simple and make point to:

    1) already having a valid permit that was clearly displayed
    2) requesting the time stamped photographs that they claim to have taken
    3) mention them already receiving communication from the representative of the land owner asking them to remove this charge

Is there anything else I should cover - or maybe upload a photo of the charge notice itself for anyone else to pick holes in?

Are they really calling it a PENALTY charge - they can't - so please check.

Yes as per one of my earlier posts - please upload your charge notice and if you can photos of signage at site. (cut out reference numbers - we dont need these).

As unfortunately you and a handful of others are the new guinea pigs of the new system - the appeals stage has not been tested yet.
we want as much info and ammo as possible to be able to give the best advice possible as we will need to throw everything at them especially in early stages.

I will work on a suitable letter for you later - and post up for other regulars to comment on.
  • 4consumerrights - Sorry wrong wording. It's a "Fixed Charge Notice".

I made a note of that when I spoke to my woman I rent from because she asked for my PCN for when she contacts them and I don't have one... I have an "FCN" - massive black writing at the top saying Fixed Charge Notice and a signature next to it.

Will just try and find my camera for a photo. Will block out details and post.
