I confirm that all the information I have provided is true and I understand any false information may be used against me in court. Should my appeal be rejected and I later refuse payment in the specified time allowed. I allow Capital2Coast to start issuing court proceedings against myself and the address I have provided. Capital2Coast is registered with the ICO and all information will be confidential in accordance with the Data Protection Act 1998.

    Yes but u cant stop someone issuing court proceedings,

    I could say you owe me money, i dont need your permission to initiate proceedings

    That so-called declaration, in technical, legal terms, is known as utter bolleaux. A desperate attempt by a private company to acquire some authority it both lacks and is quite unentitled to.

    I am disquieted by the "Please Confirm" tick boxes - Driver and Keeper (tick all that apply). Presumably, in addition to C2C's attempt at assuming authority it doesn't have this is it trying to creep past POFA which only entitles it to ask at NtK stage.

    I am not convinced that the DVLA has come to any conclusion over the IAC's original appeals procedure (which required that the driver be identified - indeed it was a condition of an appeal) - as I know who made the original complaint and despite numerous reminders the last that had been heard from them was that the matter was subject of negotiations between the IPC/IAC and the DVLA.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Note the incorrect use of "myself". How does one sue an address? One for Martin Potts I think.

    Oh I agree. I just think the court won't take too kindly to people being forced into paying the original invoice out of fear that they agree to be taken to court.

    The online form (for snail mail) does ask you to agree to you being taken to court. What if I disagree?!
