Family and housing help needed

In 2007 my dad asked me to move in with him as he was struggling living alone. He is 81. He advises me to sell my house, and with the proceeds I renovated his house to a more liveable standard fitting and paying for kitchen, bathroom, patio, front and rear upvc doors, part double glazing, conservatory, gas main fitted to enable central heating, decorating and carpet. Also I paid for all bills except for council tax which he pays for. I do all the cleaning, washing,gardening and furnishing and all household items. After I had done this, I find out that my dad had 'gifted' half of the house to my brother (who has never paid for any upkeep or purchase of the property) he also began paying him £200 a month 'rent'. My son who is 18 and has add and autism also lives with me. My brother and I have fallen out numerous times over this since I found out he owns half of the house. It has come to the point where he wants me to move out. I have nowhere to live and limited income as I only work part time. I am the only one who has spent any money on the house. My dad has left me the other half of the house in his will, but my brother has so much influence over my dad, I feel this could be changed at any time. Where do I stand and what can I do? The relationship between my dad and myself is at breaking point. My brother and I do not talk at all now. Any help or advise would really help.

    Just to add, I do not pay rent, but have been paying for the upkeep and running of the house. I did ask to pay rent and have a rent book but this was refused by my brother.
  • My brother does not and never has lived in the house (he lives in his own house with girlfriend and 2 children) it was my Nan's house and passed on to my dad who was an only child.

    Find out how much it will cost for a full time carer and tell your brother he will have to pay this if you move out.

    Perhaps living there rent free is enough - in his eyes? maybe he envisaged you living there rent free for life - and could possibly right this into his will...?

    Advice: don't spend anymore money on the house.

    Never invest in something where u have no tangible interest
  • how has he gifted the house to him, if he has gifted half of it, is your brothers and your name on deeds, or is it just still your dads name,
  • I take it your dad isn't dead, if he is leaving half the house to him when he dies, why is he paying rent

    make sure he hasn't signed it over to your brother and seek proper legal advice if he has

    if he is just giving your brother money, and house is still in his name, get half transfer over to you now,

    as if your dad dies, the hosue will be sold and split 50/50

    I would check with the LR and see whose names are on the deeds - https://www.landregistry.gov.uk/public/property-ownership

    If the house is already half-owned by your brother, your future is very uncertain.

    If your father needs residential care in the future, the half of the house that is still his will be assessed as capital. You could end up homeless.

    If your father dies intestate, the half of the house that is in his name would be split between you and your brother, leaving you with just a quarter ownership.
