If this is your 2nd sacntion for the same thing, sorry to be the bearer of bad news but it will be 26 weeks not 13.

Depending what type of sanction OP is referring to it will either be 13 weeks if it was an actively seeking employment issue or 26 weeks if his his 2nd failure to apply for a vacancy sanction

Can I ask a question about sanctions?

When does the money stop? Is it when the adviser refers the sanction or when the decision maker has checked it (how long does it take for the check to be carried out?)?

I keep hearing that the advisers do not issue sanctions it is the decision makers but surely it should be deemed as issued once the payments stop, at what point does this happen?

Depends what type of referral it is - if it is a actively seeking employment or availability referral the payments are 'suspended' awaiting a decision all others are done when the DM actually makes the decision

That is what I think is so harsh about sanctions, money is stopped before you get chance to defend yourself

Your defense is your job search or reasons for being unavailable along with any reasons you failed to look for work and your previous 2 weeks job search - all of which are asked at the jobcentre

Further to my post earlier http://forums.moneysavingexpert.com/showpost.php?p=64104964&postcount=27

I was informed this afternoon by JCP's Work Programme liaison officer that the unlawful sanction I received has been overturned. Disturbingly just as the conversation was about to end she remarked that 'the wheels turn slowly' and if it wasn't for my persistence in reminding everyone concerned about pertinent DWP regulations, and providing compelling evidence in support, 'we would not be this far'.

So much for 'customer' satisfaction. I'll happily engage in any survey about just how well JCP/DWP treat people in reality.

It was an RE sanction that the OP the was referring too. I'm aware of the different types as I'm an advisor.

Err, you are getting me confused with the person that posted the articles.

apologises, I though when you said "Desperate people resort to desperate measures, perhaps the government should look at cause and effect." you were condoning the actions taken in the articles.

No I wasn't condoning the actions taken, but I won't condemn them out of hand either. The system seems to bring out the worst in both JCP staff and claimants.
  • I put a new claim in a couple of weeks ago, had an appointment at my local jobcentre at 9am last Tuesday

Arrived at 9.08am due to their being a slight delay with the trains, explained this and apologised to the benefits advisor who processed my claim, received a letter a day later saying I was entitled to JSA and would be paid etc etc

Was due my first payment yesterday and nothing went in the bank, then a letter arrived saying that my JSA had been suspeded for 4 weeks after their being a 'doubt that I attended an interview with an employment advisor, which we have now decided you did not attend"

After frantic phone calls late on Friday it turns out that they are sanctioning me because I was 8 minutes late on Tuesday even though I actually attended and went through the appointment with the advisor and he processed my claim

Bad enough at any other time if year but as you will all note it is xmas in a few days and this decision has left me penniless until January the 8th when my sanction is finished

I am going to go into the job centre on monday and start the appeal process but there is not much chance of that being completed for me to have any money by xmas

What you all need to understand is there is a systametic attempt by staff at the Jobcentres to remove people off benefits for whatever reason, however petty and however ridiculous they can find in order to meet targets

I have been left penniless for being EIGHT miutes late for an appointment at which I was subsuquently seen and processed

Its an absolute disgrace and people need to start being made aware of what is going on

    Preaching to the converted here.

And people are being made aware. The problem is, most don't actually give a toss about anyone that's having a hard time.
