Forensic Vet Report

Just heard from my forensic vet that he has tried to make contact with the owner of the practice since last Friday. No e-mails or phone calls have been returned. So it looks as it is going to go to court. I don't think it will look very good on them failing to make any response to my attempts to settle this dispute out of court.0

In the time between the first thread on this subject, I saw my Tom cat suffer from hyperventilation. I took him Oh, there is a pity. Not sure if any oe can give advice the vet and treated him for ten days, before he stopped eating. I had him out down four days later. He was about 16 years old. Age of birth was unknown as he was a rescue cat. I know he was involved in a fight last year, and probably caught something from the other cat. He had to be rehydrated for a few weeks, mthough he never did recover.
Since then, we have taken another rescue cat in and got on with it.0 -

An "out of court settlement" usually happens after notification that there will be a court case, but before that case is actually heard. Until a date has been set for the hearing, it is not unusual nor bad form for parties not to try to settle. Also you trying to settle at a very early stage can be seen as a sign of weakness or lack of confidence in the strength of your case.
Your former vets could have been advised by their insurers not to have contact with any third parties, or they don't want to accept the forensic vet's offer of mediation as he is not exactly neutral. If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

I have already written to the practice informing them that I intend to take this to court. The reply I got was that my letter was passed to their lawyers (not the insurers) My forensic vet's attempts to contact my ex vets was to avoid court case. l As I understand the court action should only be taken if any other attempts to resolve matters fail. If my ex-vets did not want him as joint mediator they could just say so and not completely ignore him. By doing this they made it clear that they are happy for me to take them to court. That I will be doing tomorrow. What else can I do?0 -

As I said in the other thread, if it's what you have to do then it's what you have to do, but it's categorically not recommended.
Even with that report, your case is incredibly weak. Be prepared to lose and therefore owe the other side a potentially substantial amount of money.0 -

in looking for the answer you want, the necessity of truth gets clouded.
I could of said on my Tiger is Hyperventilating thread, Tiger dies ten days after vet gave tablets. https://forums.moneysavingexpert.com/discussion/47810480 -

You are being incredibly naive if you think a biased report stating the views of a vet paid for by you was going to force the hand of the vet into instantly settling out of court.
They can now get their own forensic vet to refute all the points raised in the report you paid for that is biased towards your point of view, which I'm sure will be their next step.
Any sort of settlement is a very long way off, if it ever gets that far.Accept your past without regret, handle your present with confidence and face your future without fear0 -

Just wondered why you feel my case is week? The report is 12 pages long and the 2 quotes that I have posted do not do it justice. Just had a development. A phone call from my vet's insurers. I was informed that my ex-vet's practice has been sold that is why the owner has not contacted my forensic vet. For some reason the staff at the practice did not seem to think that it would be appropriate to inform him of this. However he has passed on my case to the insurer's who are now reviewing my case. So for now court case in on hold.0 -

I have got a legal insurance with my house policy. They are looking through my case and if they think I have 50% chance of wining will give me go ahead.0
