what gets me is my m8 got his PAC code within 24hrs via text, nothing to do with the T&C's etc. I've read some people saying they'll get theirs with 21-28 days and EE questioning back dating:huh:

If they gave the people who won their codes quickly they wouldn't have to worry about backdating as much.

does anyone have an email for EE? I'm waiting to hear off them about when I'll be getting my code and thought I'd just drop an email to hopefully get them moving.

    Ah, I'm getting confused then!

I'm hoping if I'm successful it will at least help, also the info I can get for the defence they will use may help. I doubt they will enforce my request for an apology for not telling me I could cancel free when they changed the ts&cs.

    Right,

EE legal just this minute rang me direct on my mobile and gave me my PAC code, is unlocking the phone as I type and said that EE legal will deal with my backdating and compensation shortly. :j

Must admit I was a bit taken back by the phone call, was expecting a drawn out email chain.

For reference I emailed my acceptance on 26/06 , so nine working days

    That's excellent news!

I'm using RandomCurves responce to your post #1072 for my daughter's contract as she had the exact same defence from EE.

For my own contract, had an email from CISAS yesterday confirming my acceptance and PAC code, compensation and backdated refund on there way. :)

That's brilliant! Hope it works out for your daughter too:)
  • can someone tell me the best way to accept a cicas decision, i know that i have to email them but do i need to add anything to the email to cover all bases if ee decide to do something dodgy to frustrate the process?
    thanks in advance

If the decision clearly states back dated and refund then accept. If it just says "backdated" then "I accept the decision on the basis that a Backdated cancellation (to when EE should have cancelled the contract) means that all sums taken under the contract since the backdated date are refunded as from that date there is no contract for EE to apply a charge to."

I have had contact from MSE - apparently they were waiting for me to responds to an email they had sent (99% sure I had responded, but hey ho).

So will delay the new campaign a little longer as if we get the right publicity from the start (including shining a big bright spot light on Ofcom's stance) we may find things will happen a lot smoother!

And just in case EE do try to wriggle out of this based on the timing I will include a parallel case that requests a refund of ALL previous price rises (as EE have admitted in their T&C defence that the old clause was likely to be unenforceable - I know it was unenforceable as I won 2 cases against them on family members contracts)! And the time limit for reclaiming those price increases is SIX years so we can ride on the back of that if necessary for the T&C change :)

Really appreciate this RC, gutted that my first claim failed, so looking forward to at least pressuring OFCOM, EE et al.

Its been exactly 5 working days since I filed my case with CISAS. Nothing from CISAS, should I file once again?
