Has anyone received a response from OFCOM re the chase for a resonse to the 2 specific questions we raised?
I'm yet to receive anything and it's now been close to 60 days since my original complaint was raised, if you've not got anything back it's probably worth replying copying in media again to highlight the lack consumer support we're getting.
had to stop myself from adding in "appreciate it must be difficult to diarise time with Olaf and Jeroen, but surely in 60 days you must have had at least one golf day with them to discuss how best to get your next price rise/T&C change through"
I guess with Tennis to attend and matches to attend in Brazil courtesy of Olaf and Jeroen it must be difficult for them to find time for the consumer (Note for the legal eagles - I am merely shooting the breeze and am not for one minute suggesting such outlandish behaviour would happen at a regulator that has displayed such a passionate and exemplary record of consumer protection against the excess of the industry on so many occasions in the past -now work out which one is the joke!!)0 -
The longer Ofcom delay the more certain I am they will side with the industry. If they looked at the facts of the case they would see straight away what EE have done with the T&Cs and they know the GC 9.6 regulations (Ed Richards help to write it apparently) and they know the UTTCCRs (as a desiginated enforcer):
OFT Group 10 regulations
"10.2 If a term could be used to force the consumer to accept increased costs or penalties, new requirements, or reduced benefits, it is likely to be considered unfair"
AND
10.3 (c) there is a duty on the supplier to give notice of any variation, and a right for the consumer to cancel before being affected by it, without penalty or otherwise being worse off for having entered the contract.
So the only possible cause for delay is to discuss with the industry either How to put this right without effecting the businesses OR (more likely) What weasel words can be used to avoid doing anything (Administrative Priorities being the favourite get out of jail free card).

Just wondering if anyone can advise on this - I got my decision from CISAS a few weeks back, and won a cancellation etc. Not accepted yet, have been holding out as I need to decide what to do. I want to switch to PAYG and then pick up another contract in a few months, and I also want to keep my number. My iPhone is locked to EE, so is it possible just to get them to change my contract to PAYG instead of cancelling? This way I avoid having to get my iPhone unlocked and can then just cancel when I want to. Not sure how this would affect backdated compensation though? I thought they needed the PAC code to cancel and refund? Cheers0

You'll have to use the PAC code to get your refund I imagine. As for changing to PAYG, I don't know if it works like that. New contract / new PAYG = new sim.
As far as unlocking is concerned, I think you can pay to have it done fairly cheap. Otherwise I think the only other possibility would be to use a PAYG sim from T-Mob or other company that uses the network (like Virgin). Not too sure. You might be able to unlock your phone yourself if you read up on it and feel confident to do so.0 -

Have you just tried to order an unlock code online with EE? I belive as long as you have had the phone over 6 months they will unlock it, and the system seems pretty automated. I requested my iPhone to be unlocked a couple of weeks before I started my claims process, paid the (I think) £23 and it was unlocked after a few days. Granted you are in a different position, but if you get the request in before requesting a PAC code you have nothing to lose.

Thanks for the replies guys. Unfortunately I git my iPhone from CEX a couple of months ago and just put my SIM in it, so don't think they will unlock for me. I'll look into getting a t-mobile SIM and port my number to that. Cheers0 -

Try local phone shop, my m8 just got a 4S unlocked at one for £25, took about a week to get code but all working now.0 -

I did this once I found out I had won my case, they add the amount too your next bill but as I have now cancelled the contract they have refunded the cost back. It's worth ago.0
